Barington Capital Wants to Inspect Dillard's Records About Perks, Business Relationships
NEW YORK (AP) - A hedge fund attempting to gain four seats on the board of Dillard's Inc. has asked to inspect the department store chain's records related to executive perquisites and business relationships, according to a regulatory filing on Tuesday.
Barington Capital Group LP, led by James Mitarotonda, and its affiliate, Clinton Group Inc., has blamed Chairman, President and Chief Executive William Dillard II for Dillard's declining stock price.
The hedge fund asked for the records related to executives' perquisites or non-cash compensation, use of company aircraft and business expenses. Barington also asked to inspect records regarding contractors and construction developers, family and business relationships and the company's retirement trust.

This holiday weekend some Indiana residents remain out of their homes and the clean-up effort is still underway. From homes to businesses, residents in Milltown, Indiana, one of the hardest hit areas, are trying to salvage whatever they can.
Now that the waters have receded, many folks are getting a first look at just how much they've lost.
"I've seen [the water] come up a hundred, thousand times," says Ricki Ashley, whose home was destroyed by flood waters. "I knew it wasn't going to get the house. But when it came up that road... I knew then, we lost everything."
In 15 years living in his Milltown home, Ricki Ashley had never seen anything like he did this week. The Blue River rushed up to his doorway and within hours, came right on in.
The water knocked his house off its foundation, and then rose to about a half-foot inside ruining nearly everything. more

With light snow falling early in the morning, it was business as usual for many shops and restaurants along the Highway 23 Bridge detour route.
Lacie Gerads at Hourglass Cleaners said it was too early to tell how the closure could affect customers. The dry cleaner is located just blocks from the closed bridge. Gerads said she thinks the store will do well, despite the closure, because many of the customers come in on their way to and from work downtown. Hey everyone! So I recently started a web-based store. It's actually beginning to pick up some steam and I'm amazed at how much fun it is to manage everything. I'm enjoying the business I've been getting but I think I'm ready to really start getting word out a bit more about it and I want to find some good ways to promote. It's a Christian business and the demographic I'm seeking is Christians between the ages of about 15-35 (tentatively.. it's not a "MUST" demographic, obviously). It's also a certain style, more tailored to fit people who are heavily into music and expressing themselves creatively (artists, dancers, athletes, photographers, stylists, etc, etc, etc). So I'm wondering what the best way to promote would be. I was thinking of hitting up forums or other places where people get together and discuss websites and things. Could anyone suggest some good sites?? I don't know many good forum spots. I was also wondering if there's an effective way of networking on Myspace other than just adding people and talking to them (like is there a forum spot I'm unaware of or something?). I am a graphic and web designer. I took on a client that runs a non-profit organization and agreed to set up her website for a very discounted price because it's for a good cause and I know she's on a tight budget. When we first discussed what she wanted done, I quoted her a price, got half the money upfront and expected to receive the balance upon completion. Over the last several months, she has continuously asked me to alter and expand the site so now it's gone from a simple information website to an information and social networking site. I have done the work, but now I feel as though I'm being taken advantage of: not only have I completed the work we initially agreed upon, but I have done work far outside of the scope of what was asked for in the beginning. I have a conference call with her coming up, and I'd like to address the following: that I finished the work she needed done initially for the price we agreed upon long ago. I need to be paid for THAT work. The work that I've been doing that is outside the scope of what we first agreed upon - how do I ask her for more money (since it was more work and not covered under the agreed upon price) without upsetting her and possibly losing her business, or even worse, having her not pay the balance that she already owes me? I want to handle this diplomatically and without upsetting her, I just don't know what to say. What's the proper etiquette here? ok. I just recently graduated college with a diploma in general business which really means nothing. So I am going back to school this month and I am not sure what to study. I am thinking of specialising in something like Financial Planning (also a diploma). However I think a lot of people are graduating with degrees in the business field and someone like me with a diploma would not have much of a chance in getting a job. My other option is the Information Technology Applications and Technical Support course. But this is only a 51-week Certificate program. Since its a technical skill I probably have a better chance of getting a job after graduating. What do you guys think? I have a friend that makes bookmarks, and she knows nothing about computers or the web, but wanted to put them online so that people could look at them when she hands out her business card. EL PASO -- At least 41 businesses in El Paso will be part of a national audit of 1,000 businesses by federal officials looking for immigration violations in hiring workers. The audit will be among the biggest in El Paso by Immigration and Customs Enforcement, a move that drew immediate criticism from a local immigrant-rights group. The local businesses chosen for audits were not named, but the agency said on its Web site that all the businesses selected for inspection were the "result of investigative leads and intelligence É and connection to public safety and national security." The Border Network for Human Rights, based in El Paso, opposed the audits. "We are saddened and disappointed that two years after the disastrous 2007 immigration raids that tore apart families and penalized American businesses, the federal government is once again adopting a shortsighted enforcement-only approach to immigration policy," the group said in a prepared statement. The group also said the federal government should concentrate its efforts on fighting crimes along the border such as drug trafficking and gang activity instead of "harassing hardworking families and business owners." Of the 1,000 businesses nationwide, 161 are in Texas. In addition to the ones in El Paso, there are about 60 in the San Antonio area and 40 in the Houston area. When the audits will take place and how they will be conducted has not been announced. "ICE is focused on finding and penalizing employers who believe they can unfairly get ahead by cultivating illegal workplaces," ICE Assistant Secretary John Morton said on the agency's Web site. According to The Associated Press, dairy farmers in Vermont were among the businesses getting notifications from immigration officials to turn over payroll and hiring records, said Kelly Loftus, spokeswoman for the Vermont Agency of Agriculture. Some dairy farmers say they use foreign workers because it is hard to find people locally for the work. Richard Dayoub, president and CEO of the Greater El Paso Chamber of Commerce, said, "They (ICE) are really taking an effort by their part to understand the depth of the problem. I'm not sure what they will accomplish." At the same time, the Homeland Security Department announced it would give a seal of approval to businesses volunteering to use an electronic program to check workers' immigration status. Homeland Security Secretary Janet Napolitano said Thursday that the public should know which companies are following the law. The problem is that the program known as E-Verify is still under development, and the law does not require employers to use it. They are required to use a paper system. E-Verify is an Internet- based system that allows employers to voluntarily determine the eligibility of new hires to work in the United States, using information provided on the employee's I-9 form. The E-Verify campaign is being promoted by ICE as a way to help employers maintain a legal work environment. "All employers have an obligation to assure that they have a work force that complies with the law," El Paso Mayor John Cook said. "They E-Verify system will implement technology to assist employers with that responsibility." Cindy Ramos-Davidson, CEO of the Hispanic Chamber of Commerce, said she felt that the E-Verify system was not up to speed, and that all it took was one small error to set up a business for litigation. The last nationwide audit conducted by ICE resulted in 14,000 suspicious documents. FCC Votes to Begin Crafting `Net Neutrality' Rules Oct 22 12:42 PM US/Eastern By JOELLE TESSLER AP Technology Writer WASHINGTON (AP) - Federal regulators took an important step Thursday toward prohibiting broadband providers from favoring or discriminating against certain kinds of Internet traffic. Despite the concerns of telecommunications companies and the agency's two Republicans, the Federal Communications Commission voted to begin writing so-called "network neutrality" regulations. Proponents say the rules would prevent phone and cable companies from abusing their control over the market for broadband access. FCC Chairman Julius Genachowski said regulations are needed to ensure that broadband subscribers can access all legal Web sites and services, including Internet calling applications and video sites that compete with the broadband companies' core businesses. "Internet users should always have the final say about their online service, whether it's the software, applications or services they choose, or the networks and hardware they use to the connect to the Internet," Genachowski said. The FCC's two other Democrats voted to support his plan. The agency's two Republican commissioners voted merely to start the formal rule-making process, but said they are opposed to the substance of Genachowski's proposal. Republican Commissioner Robert McDowell said he remains unconvinced that broadband providers are engaging in widespread anticompetitive behavior that requires government intervention. "I do not share the majority's view that the Internet is showing breaks and cracks, nor do I believe that the government is the best tool to fix it," he said. Next up for the FCC is to actually craft the rules, with a vote on whether to adopt them expected to come by next summer. That would culminate a five-year debate in Washington that has pitted Internet companies such as Google Inc. against some of the biggest phone and cable companies—including AT&T Inc., Verizon Communications Inc. and Comcast Corp. The broadband providers insist they need flexibility, free from government intervention, to keep their networks running smoothly. They want to ensure that high-bandwidth applications such as YouTube videos don't hog too much capacity and impede other traffic, like e-mail and online searches. They also say that net neutrality regulations would discourage them from expanding and upgrading their networks. "We continue to hope that any rules adopted by the commission will not harm the investment and innovation that has made the Internet what it is today and that will make it even greater tomorrow," Comcast Executive Vice President David L. Cohen said in a statement. But companies such as Google, Amazon.com Inc., eBay Inc.'s Skype and Facebook Inc. argue that without such rules, the broadband companies will become online gatekeepers that can prioritize their own online services or those of their business partners—and potentially put others at a disadvantage. Genachowski's plan calls for the agency to formally adopt four broadband principles that have guided the FCC's enforcement of communications laws on a case-by-case basis. Those principles state that network operators must allow subscribers to access all online content, applications, services and devices as long as they are legal. The FCC relied on those guidelines last year when it ordered Comcast to stop blocking subscribers from using an online file-sharing service called BitTorrent, which is used to transfer big files such as online video. Comcast is challenging the FCC ruling in court. Genachowski also wants the FCC to adopt two additional principles that would bar broadband providers from discriminating against particular content or applications and require them to disclose network management practices. Setting up a firewall configuration for a small business A small company with computer resources consisting of a Ubuntu server and a Windows server, a group of desktops and laptops requests a network setup and firewall configuration that will provide more security and control. Two machines will be used as firewalls. They have decided on a network topology where the laptops and desktops are placed in the same subnet, but they are separated by a level two bridge. This makes it possible to install a stealth firewall on this bridge. (Conviniently the topology is equal to your virtual network, except for the bridge, so you need to change this for your virtual network.) Installing server and client software In order to make the network more realistic and thereby also testing the firewall setup, you shall start by installing somserver software. Marc Rotenberg, president of the Electronic Privacy Information Center, said the White House signaled that it would insist on open dealings with Internet users and, in fact, should feel obliged to disclose that it is collecting such information. "The White House has not been adequately transparent, particularly on how it makes use of new social media techniques, such as this example," he said. Defenders of the White House actions said the Presidential Records Act requires that the administration gather the information and that it was justified in taking the additional step of asking a private contractor to "crawl and archive" all such material. Nicholas Shapiro, a White House spokesman, declined to say when the practice began or how much the new contract would cost. Susan Cooper, a spokeswoman for National Archives and Records Administration, said the presidential records law applies to "social media" and to public comments "received by the president or immediate staff." Orton and Kennedy have been very good friends in the past and often hung out together on the road. There were people after who congratulated Orton on not losing his cool on how he handled it. Orton wasn’t seriously injured and worked a short dark cage match the next night with Batista, and then worked on top during the Mexico tour, although Show was carrying the action in the tag matches over the weekend. Orton was icing his shoulder after the match and Orton’s injury was considered more serious than Kennedy’s. He complained of a stiff neck at television the next day and was still icing his shoulder and getting massage therapy, and made comments about Kennedy being a careless worker but it was not any kind of a major piece of conversation at the Smackdown show. Four days later, John Laurinaitis gave Kennedy the phone call, basically saying the boss (Vince) made the call, being nice about it and saying that hopefully in the future they could do business again. Virtually everyone outside the inner circle was shocked, as wrestlers who found out about it after WWE put it in almost a hidden spot on its web site, were doing double-takes like it was nothing they expected. Those on the road didn’t even believe it at first. There was an assumption among many that Orton went to Vince and pushed the issue, but nobody seems to know if that is really the case. It was considered to be a done issue between the two once TV was over. However, that was the straw that broke the camel’s back in Vince McMahon’s mind. On the flight back from Los Angeles after Smackdown, Vince cut a promo on him to the inner circle. He said Kennedy was a reckless worker and said he was green as a mechanic and green when it comes to business instincts. The only real backer he had was Austin, but Austin is pretty much out of the company at this point. A lot of the better workers in the company were not high on him and didn’t like working with him. It was not personal heat but a lack of respect because they saw him as an average talent who was all smoke and mirrors because of his catch phrase. My impression is the guy, as much as he seemed to have a propensity for making himself look like a fool outside the ring, had very strong charisma and a good gimmick. A couple of top guys, Orton not being one of them, were believed to have gone to Vince bad mouthing Kennedy. At least four of the company’s best wrestlers did not like working with him, three of whom were on the Raw brand he had just been drafted to. Matt Hardy on his Myspace page said Kennedy was one of his best friends in the company and hated to hear the news he was gone, and others have corroborated that he was popular with a lot of the wrestlers. It is believed TNA has an interest in him, but in his case, the situation would be that TNA would likely want him to sign a three-year deal. One person close to Kennedy noted that he’s looking forward to going to TNA in September (after his 90-day non-compete period ends), that he has a lot of confidence and believes he can be a real top guy, but believes Vince McMahon doesn’t see him at that level. Hello, my question is this. I have a popular website that I've been running since 2000. It's a static web 1.0 site that sells access to a membership. I was considering the idea of adding some ideas like: a blog, a wiki, a classified ad section, and most importantly a social networking module to the site. Trying to decide if this is worth doing? Perhaps the biggest problem is what if paid members start sharing their passwords to login on those new channels? So on the one hand it might hurt business. But on the other hand I could start to develop a great deal of user generated content to grow the site and it's following. This is the article: The Scottish tourism industry will be "dead in the water" without embracing new technologies. The warning came from Alan Rankin, chief executive of the Aviemore and Cairngorms Destination Management Organisation, ahead of Tourism Innovation Day, on February 28 in Glasgow. Rankin, former chief executive of the Scottish Tourism Forum, spoke out following results of a Scottish tourism survey carried out by Highland Business Research for Tourism Innovation Day, which showed that 59% of companies felt that they could do better in terms of embracing technology. Sorry for this lengthy post. I tend to ramble in full detail. Anyway: Have gradually met and become acquainted with this woman over the past year, as our daughters are in the same weekly ice skating lessons, and our boys play together running up and down the bleachers while the parents watch the skating. Over the past couple of months, I have slowly tried to build our acquaintance level, engaging her in brief conversation at the weekly skating lessons. We've talked about the boys (1 year apart), the girls (2 years apart), house buying, the kids' XMAS wishlists and what they wound up getting, a bit about our jobs, our homes, our pools. Mostly small talk that you'd expect between parents who really don't know each other, but just having casual conversation. However, she has also elaborated on a bit more personal information in some of our conversations, about how her husband works nights, and she works until 2pm and then shuffles the kids to their activities, and 2 weeks ago, while talking about the kids and their XMAS gifts, she mentioned that her daughter has a different father who is totally out of the picture. We chatted for most of the 40 minute lesson that night. So, anyway, that is a summary of the history of our acquaintance. NOW, I have really taken a liking to this woman over the past 2-3 months. Thru the power of the web, I found out her name, age, address and phone number, employer, and social networking sites. She has a peekyou.com account with a couple of photos, and she has a myspace account that is set to private. But what has really got my emotions and conscience going berzerk is her myspace profile page pic and her current mood state. It is a beautiful pic of her in her wedding dress, and the mood has been stuck on "lonely" for the past month since I found her myspace page. So, my emotions have me thinking that she may be in another unhappy relationship. NOW, I have decided to try to advance our acquaintance as cautiously as I can without stepping over boundaries and ruining what we have right now. After our pleasant and somewhat detailed conversation two weeks ago, I emailed her a short and unimposing message, just mentioning how I learned that her name is such and such, and how I didn't believe that we ever formally exchanged greetings during skating lessons, but that now I could put a name to a face. That was it. Of course, I was hoping that she would reply and start up a conversation. Well, she did not reply to that email. And last week, she was not at the skating lessons, likely due ot a big snow storm we had that day. Anyway, well, she was there tonight, though. Again, I didn't want to come on too strong and obvious, so I picked an opportunity when our playing boys brought us together, and I greeted her, and I proceeded to tell her how I came across her name, which was the result of an email to all the parents of the skaters, and I recognized her last name and place of business in her email address, and a google search on the oddly named company presented me with a business review on her company, and she was in a picture along with some other office staff. And she mentioned then that she got my email, and she wasn't 100% certain, but she thought it was from me. ANd we talked a bit more about her job responsibilities. My boy inconveniently took me away from the conversation, as he had to go to the bathroom. I got back to her with just a couple minutes left of the skating lessons. She asked me how old my son is again, and I briefly discussed our recent potty training success. Then, we were together again in the skating rink arcade after the lessons, as the kids got popcorn from the snack bar and, we both put quarters into the air hockey game for the boys. I finally wrapped up my kids and said "see ya next week". Now I have to wait another 7 days before I'll see her again. I will again monitor her myspace logins and watch to see if her mood status remains on lonely. She checks her myspace a couple of times per week. BUT I will not look to contact her (friendship request) on myspace because I think that will clearly demostrate my affection for her, and knowing that she is still in a marriage, and I really have no certainty regarding her marital relationship, if it is not going so well or what. I only have her myspace "lonely" mood status to go by, along with some of the bit more personal things that she has shared in conversations (a few of which I've mentioned here). I also most likely will not contact her via email again, as I don't want to be perceived as stepping across her boundaries and possibly turning off our budding acquaintance. I think my only sensible gameplan for now is to just maintain our friendly conversations at skating lessons and see where I can carefully steer the conversations without coming across as intrusive or boldly showing my strong affection for her. If I gain the insight that her marriage is okay, then I certainly wouldn't look to advance our relatirelationship any more than what it is now. If I can manage to advance our friendship a bit more to email exchanges or myspace/facebook exchanges, then I could potentially call her out on her "lonely" mood status, and see what that reveals. I guess what I am looking for is some advice on how to advance our conversations and friendship level, with a certain level of respect for her and her life. What topics should I carry on with, and how can I carefully steer them in the direction that I want to go, to the point where I'm going to possibly gain the insight that will tell me to continue my desire to advance her or to back off. But you cannot afford to close your eyes to them, because they're simply the most explosive outbreak in the information world since the Internet itself. And they're going to shake up just about every business—including yours. It doesn't matter whether you're shipping paper clips, pork bellies, or videos of Britney in a bikini, blogs are a phenomenon that you cannot ignore, postpone, or delegate. Given the changes barreling down upon us, blogs are not a business elective. They're a prerequisite. (And yes, that goes for us, too.) There's a little problem, though. Many of you don't visit blogs—or haven't since blogs became a sensation in last year's Presidential race. from the begining my mom would want to get on ht enet to work on her online business. For a long time all the rest of the family would want to get on. so finally after four years of not being able to work on er website. she finally gets her own computer. We don't have a network no so we have to wait for her to get of on her computer before we can get on. Every morning now (for four months) she has been telling me she is getting info off line to help her with her web site. That would mean some times she would have to chat to some people. but for a while every morning she is in the yahoo chat rooms. and she stays on until 12:00. she always say she get tired at nine by she forces her body to stay wake so she can get some work done but she stays on forever. there are 5 others who wants to get on the net too, and she hogs the internet for ever chating. I never see her on freewebs.com (that where she has an account) she is always on the yahoo chat. She doesn't even come out of her room to spend time with us. She would lock the door alot (she has a rule of no locked doors) and says she need privacy.
