The 6.6% decline in comparable sales proved enough to send total sales down 1.5% to $270.1 million, but could improve as the year progresses -- management expects a low- to mid- negative single-digit range for the full year. Taxman's binding and not-so-binding rulings

A good example of a recent ATO publication is a draft, "Self-Managed Super Fund Ruling on Business Real Property or BRP (SMSF 2008/D3)." No one should underestimate the complexity of this issue. This draft ruling, which the ATO does not expect to have finalised until later this year, runs to 68 pages and in our estimation doesn't waffle and isn't overly repetitious.

BRP is real property used wholly and exclusively in the running of one or more businesses, and the definition of BRP is important to an increasing number of SMSFs. One of the key issues about BRP is that a super fund can acquire it from members, their relatives or related entities (such as companies or trusts) at a genuine market value.

Open Question: Where do I post an injustice for everyone to see?

Just need to vent. I'm a small business owner just trying to get started up. I'm a gamer so I figured why not make a store like gamestop. I invested in games got some rental software from Vision who has an agreement with Mercury Payment Systems to accept CC's... so since I could not use Paypal and wanted to give my clients the option to pay with a CC I figured why not. I got into a contract with Mercury and they said we'll charge you $40 a month plus a percentage for each CC transaction. Fine... so a year passes... most people around here were using cash... it was rare to get a CC transaction for rentals, so why waste $40 right. I contact them to cancel in January already been with them over a year. I get a reply with a form saying I'm going to cancel and will be charged a $295 termination fee. Ok, so naturally I ask how to avoid this fee. They said according to my contract I need to give them 30 days written notice. Ok so I reply yeah.. I'd rather do that...(DUH!!!) Then I ask.. does this email count as a written response? They reply and say no and attach a form I need to fill out as a written notice. (OMG Pulling nails WHY did they not just give me this option before! GRR) Whatever I do as I'm told and confirm they got my fax bla bla bla itz done. I budget as needed and pay my bills... then today when I check my account OD's upon OD's!!! Right on the top Mercury Payment Systems $295 charge. WTF! Naturally I call knowing it has to be a big mistake... ohhh noooo apparently I have to continue my "normal volume" of sales in the 30 days or else the fee is applied... so I happily point out that my normal volume of ZERO can't equal anything more than ZERO! Long story short they pretty much say tough and refused to help. I review the contract they sent me while I was inquiring about leaving and in plain english it states that yearly customers simply need to turn in a 30 day notice to cancel and the fee is waived.... no talk about "normal volume of sales" or any other BS they're making up. I'm tired of this. Having no voice and just having to get slammed around by companies like this. I mean they know I'm screwed... what do I do pay some lawyer who'll just add to the spiraling fees and charges they've caused?! They know I'm stuck and don't care. I hope I can somehow spread the word of this company because people need to know this kind of information. What kind of company kicks a small business owner while they are down? Seriously? Well thatz my rant. more

Resolved Question: How will financing be for me?

Opening a tanning salon(something neat and sophisticated looking.) has been in my plans since I was about 14. All during high school I was home schooled and I worked for my dad cleaning newly constructed houses/businesses before they were put on the market for sale or lease. That is until things went under and he had to file for bankruptcy on all of the residential and commercial real estate that he developed. The I went to Costco for 2 years. From the 4 or so years I worked during school, I hoarded nearly every penny I made so I could fulfill my dream as an entrepreneur when I graduated from high school. Right after graduating from the Fulton County Public School System, I was set and went out looking for SOMETHING else to do to start my career in a self-owned business. Everything exceeded what my budget was set on until my dads good friends' dad was retiring and selling his repo company. So, I knew then at that time that was my opportunity. Luckily he allowed me to finance everything since he owned the stuff and he also let me walk in his lot that he's now leasing to me. So I've been in the repossession/recovery business for over a year now and with the economy HOPEFULLY shaping up, I've really been thinking about getting rid of my trucks & selling everything(of course after I have another main source of income coming in). The main reason is because I fear in about 2-3 years from now, this economy will have improved greatly and there won't be as much recovery work to cover all of my expenses associated with my company. ---OK so now my story about my young life is over, I'll get to my main concern- Although I'm only 19 now, I've had credit since I was 15(I lied about my DOB on credit card apps which has now been corrected with all 3 credit bureaus). Every since then I ALWAYS did right and kept my credit immaculate as it still is. My Transunion FICO through MyFico is at 738 and is slowly rising as my accounts grow older and as my personal vehicle is on its way to being fully paid off. I do have credit cards, but have $0 in credit card debt. Since Mar. 8th 2009 to Dec. 31st 2009, my company has grossed approx. $480K. That number may be fairly large, but considering I have 3 other drivers/employees I pay commission to, repo insurance(nearly $13K for not even the full year), rent on my ex-car lot(just over $20K for not even the full year), tax, all utilities, and after going ahead and paying my "agent" off for financing the PC's, software, trucks etc., that number was lowered significantly. Fortunately, 2010 so far is just as busy as it has been for the past 10 months and I'm even having to send repo orders back to finance companies from not having enough time to do them all(I'm not buying another truck). Like I said, I'm really thinking about going into the tanning business and it's a decision I'll have to make between now and the next 2-3 years. Would someone like me at my age(I will be 21-22yo then) have a hard time being approved for a $300K+ loan with the following factors: Company grossed $480K.(Honestly I want to leave this out of the app.) I netted about $110K during the last 3 quarters of '09.(before all of my personal bills/expenses.) I have roughly $80K in assets(2 recovery trucks, a money market account, and other misc. things). I have 3 checking accounts(2 personal, 1 business) I have 2 savings accounts. I have tax forms that have been filed and I also have bank and broker statements to prove my income. I have above average+ personal credit but no business credit.(no debt besides personal vehicle which will be paid off in 2 years or sooner) I have the knowledge, skill and common sense to know how to properly run a business. I can produce a legitimate business proposal. Hopefully within the next 2 or so years all of my assets and everything else will have grown.(if it doesn't there's a problem. lol) I know this is a lot of info, but my life ahead is really sticking to my nerves and I need support. I saw how my dad went from one minute having a lot of real estate to the next minute having to dig into his retirement money, and I want to avoid this by all means possible. I could be making a mistake by wanting to stop repossessing vehicles but as I said, I feel when this economy shapes up I won't even be grossing enough to cover everything and I don't want to lose my ***. The big question, how will banks view my status when attempting to obtain a commercial loan for roughly $300K? Would it be best if I go through the SBA? About 9 months ago my job description and role changed. I was originally hired for a non technical position at 60K. I happened to have a variety of programming skills they needed, web, software, database, and also system administration know how so they changed my position unofficialy to technology. I developed a web based application to do what a piece of software that cost 40K which we wanted to buy would do, but we didn't have the money in the budget so I stepped in. I recently had to create another application, though rather small this time. Right now I am working on another application, that is rather complex and large. I have been doing this latest project one on my own time, because my NDA states that anything I develop on the job becomes company property and I want to reserve the option to sell it as my own product. So I want to show my boss what I have been working on, and negotiate a pay increase, then complete the application for the company. My boss has told me and my other three co-wrokers who's positions have also changed (though theirs in non technical areas) for almost a year now that he is going to have HR reclassify our positions and pay, but it has yet to happen, he keeps putting it off, saying this quarter, next quarter, etc. So I can keep the application to my self and sell it in my own consulting business part time, OR go to him and express my frustration that I am underpaid for what I am doing. He would love nothing more than for me to develop this application, but I expect to be compensated like any other developer in the market. So how do I have the conversation with him? I am an experienced Recruitment Consultant who has decided to team up with a bunch of colleagues to go it on our own and start up our own Recruitment Consultancy. Now none of us are naturally gifted when it comes to html and computery stuff however we have managed to create our first draft of the website using Wix.com and I must admit that it is really starting to look quite snazzy. The problem is that we now need to develop a CMS that will make updating the site with our latest jobs and blogs nice and easy. We also want to be able to provide a system where candidates can supply their information (including CV) through the website directly on to our candidate database software. We are planning to use a piece of software called RDB Pro that will act as a database for all our candidates and clients. So we have the website and we have the database software but how on earth do we get/create a cms that can integrate with both and also let us upload and manage our web content easily. I know that in business one of the greatest hurdles to overcome is getting a system where the user can focus entirely on the stuff that generates the sales and doesnt have to muck about with all the technical mumbo jumbo and that is why I am so keen to get this bit right! We have not allowed anything in the budget for this so it will have to be something that is "home cooked". By refusing to honor billions in state-issued IOUs beyond Friday, California's largest banks intensified the state budget crisis and created potential cash-flow problems for vendors and local governments. The big banks, led by Bank of America, Wells Fargo and Chase, held firm in their promise not to accept the state's registered warrants after the close of business Friday. Business owners and other IOU holders scrambled to find alternative methods of cashing in the notes, such as taking out short-term loans or applying for membership in credit unions still willing to accept the IOUs. The only major banks to relent were Citi and Bank of the West. Citi said it would honor the IOUs until next Friday, and Bank of the West said it would accept them from current customers "until further notice." "We wanted to help our existing customers," said Bank of the West spokesman Jim Cole. The other big banks said they would offer lines of credit or other forms of assistance to cash-strapped customers, but only on a case-by-case basis. "We'll work with them, just like we always do," said Bank of America spokeswoman Julie Westermann. But "we will only make loans to people who are creditworthy," she said. More than $390 million in IOUs have been issued by the state controller's office since a week ago Thursday, with another $2.5 billion set to go through the end of the month. As long as most big banks were willing to honor the notes, recipients could treat them like regular checks. When that ended Friday, they started looking for answers. I am setting up a sever for a client that has a small business of 15-20 people. I was wondering whether to go with Apple or Windows based server. Yes I know I went to college for this but I want some feed-back on this because this is one of my first IT jobs were i have a nearly unlimited budget. I was planning to go with Apple. Here is what I came up with: Mac Pro- Two 2.26GHz Quad-Core Intel Xeon 16GB memory 4TB hard drive Dual-channel 4Gb Fibre Channel PCI Express card Mac OS X Server Xsan 2 Price Quote: $7,547.00 At each desk there would be a 24" Apple LED Cinema Display and wired full Apple Keyboard and Wired Mouse. Price Quote: Around $15,000 Overall the cost would be around $25,00 to $27,000 with all the maintenance and extra software. The small business is a creative designer based company so Apple would easily be the best choice for the business. And with the Apple Cinema display it would be easy for the colleagues to connect their Apple Macbooks directly to the monitor and then also share data between the Airport Extreme and Time Machines with files from their own laptops. Voting Question: Did Ibragim F. Yuldashev Frauded Me?

In June 2008 Mr Yuldashev was provided the "specification analysis" of a new software for my company. This analysis was written by a third party developer. Mr Yuldashev provided us with a budget and time request. My company accepted his proposal and he was appointed the job. The total project was worth over 9.000,00 USD. For 4 entire months, my company paid him a monthly fee, to cover the cost of the code he was delivering. The payments to Mr Yuldashev were made always on time, as per the scheduled agreed upon: September 2008: 1.100,00 USD October 2008: 3.600,00 USD November 2008: 2.300,00 USD December 2008: 1.200,00 USD Total Paid to Mr Yuldashev = 8.200,00 USD Unfortunately, just 4 days after the last payment and one week before the delivery of the software - on December 12th 2008 - Mr Yuldashev wrote us the following email: "Dear Mr Carlos, I have a very bad news for you. As the result of my efforts to hack system and supply it in time without refactoring current I've made too many changes that makes current code base unusable. In fact, current code needs almost the same efforts to complete it as rewrite it from scratch. So, I have to diagnose current situation as unsuccessful and project needs restart or die." It sounds incredible, doesn't it? Well, it's not all. When asked to attend a conference-call with the other people involved in the project, he replied: "Dear Mr Carlos, as I've explained to your consultant today, I prefer to use email for any following contacts. I think that it would be most effective and productive way in our situation." I was astonished. Is it professional to hide from your Customer without the guts to explain him the situation face-to-face, or at least over the phone? How can you cancel a project with an email like that? Without providing any further details? I've been in business quite a while, and I know that if I did something like that, I'd be closing in a few months. But Mr Yuldashev must be still young - maybe born around 1978 - and he doesn't realize yet that in real life you are responsible for your actions. Using a metaphor, from my point of view, it is like I paid for a new car that was delivered to me without the engine and without any explanation of why this happened. I have had to cut out: breakfasts, oil changes (have not had one in 1 year and 3 months.),new clothes, new socks, house cleaners,slower internet speedm cutting out cable soon if they let me get out of my package, I alternate between phone and electricity every month so I am constantly behind on one bill. I have to have the phone because I work from home and internet for online courses. I have cut out napkins, medicines sometimes, only put $10 of gas every two weeks, I do laundry once or twice a month. I can not afford laundry detergant so I buy the small box of detergent for $.75 at the laundry mat. I had to cut out acne medication and have had troubles with acne. I use hand soap and hot water to wash my face but still get huge pimples from time to time. I have also had to cut out dental insurance and lost half a tooth. I have to make a tube of toothpaste last for months at a time. I had to stop using mouth wash that helped my gums. I could not even afford to buy software for a class I had to take and almost flunked it. I am not used to living like this but I am willing to live even worse off if it means I can pay all my bills somehow. Paying bills in full is a HUGE luxery. I love to pay bills because when one is paid I feel happy. I work 35 hours a week and I have a degree in Business; working on my degree in communications. I live in the UNITED STATES. Hello! I am looking to get a new laptop, I have a Packard Bell from when I was living overseas, I got it 2-3 years ago. It has been reliable but here are some things I don't like about it that I want to improve with my next laptop purchase.... Hello! I'm looking to get myself a new computer and Pro Tools 8 (M-Powered). What's really going on with Pro Tools and Windows Vista Home Premium? Are they seriously NOT compatible with each other? I find it hard to believe that Pro Tools works with Vista Business and Ultimate but not Home Premium (which is what all most all new PCs are sold with)... the DigiDesign website doesn't explain much about this matter and most people I have talked to are as confused as I am. Has anyone found a solution to this Vista thing? Is there some kind of software to purchase that makes Pro Tools work on Vista Home Premium? Resolved Question: marketing idears please?

Hi, I have been running a small hairdressing Business from my home now for around a year. I have converted a room in my house into a salon and have been plodding along slowly slowly building clientele. I have a website www.coderedhair.com that i am slowly learning how to manage (it does need updating i know but im struggling to understand the software i was sold for it.) I have also handed out some flyer's but as i am living as a single parent at the moment (husbands in nigeria waiting on visa) don't have any spare funds for advertising. I send emails to my clients with offers and they each have a loyalty card that gets stamped when they spend x amount or recommend a friend. I have been in the hairdressing industry for over 14 years now and i should by rights be running my own salon by now,unfortunately bad luck has delayed this. So to make the best of my situation i need some ideas to pull in custom without breaking the bank. I need to get my business thriving fast, pay of my debts and work towards making success of myself. Trouble is all my ideas are bigger than my non existent budget. Does anyone have any miraclel ideas?? more
