Wing Lung Shares Fall After China Sets Limit on Bids (Update1)

The family of Chairman Michael Wu, seeking to sell a 53 percent stake, had sought at least three times book value, people with direct knowledge of the matter said earlier. Hong Kong's 18 publicly traded banks are valued at an average 2.45 times book value, according to data compiled by Bloomberg.
Merchants Bank was picked as the preferred bidder for Wing Lung Bank last week after offering the highest price, people familiar with the matter said at the time. ICBC said in a May 23 statement that it offered a ``reasonable price'' for Wing Lung after conducting due diligence. It didn't say whether the bid was accepted or rejected. more

"There is a problem where the jobs aren't valued as high as they should be. "Having said that, migrant workers generally make very good employees." Aberdeen and Grampian Chamber of Commerce policy manager Kate Yuill said a shortage of skills was the biggest single issue affecting all sectors of business in the north-east. FCC Votes to Begin Crafting `Net Neutrality' Rules Oct 22 12:42 PM US/Eastern By JOELLE TESSLER AP Technology Writer WASHINGTON (AP) - Federal regulators took an important step Thursday toward prohibiting broadband providers from favoring or discriminating against certain kinds of Internet traffic. Despite the concerns of telecommunications companies and the agency's two Republicans, the Federal Communications Commission voted to begin writing so-called "network neutrality" regulations. Proponents say the rules would prevent phone and cable companies from abusing their control over the market for broadband access. FCC Chairman Julius Genachowski said regulations are needed to ensure that broadband subscribers can access all legal Web sites and services, including Internet calling applications and video sites that compete with the broadband companies' core businesses. "Internet users should always have the final say about their online service, whether it's the software, applications or services they choose, or the networks and hardware they use to the connect to the Internet," Genachowski said. The FCC's two other Democrats voted to support his plan. The agency's two Republican commissioners voted merely to start the formal rule-making process, but said they are opposed to the substance of Genachowski's proposal. Republican Commissioner Robert McDowell said he remains unconvinced that broadband providers are engaging in widespread anticompetitive behavior that requires government intervention. "I do not share the majority's view that the Internet is showing breaks and cracks, nor do I believe that the government is the best tool to fix it," he said. Next up for the FCC is to actually craft the rules, with a vote on whether to adopt them expected to come by next summer. That would culminate a five-year debate in Washington that has pitted Internet companies such as Google Inc. against some of the biggest phone and cable companies—including AT&T Inc., Verizon Communications Inc. and Comcast Corp. The broadband providers insist they need flexibility, free from government intervention, to keep their networks running smoothly. They want to ensure that high-bandwidth applications such as YouTube videos don't hog too much capacity and impede other traffic, like e-mail and online searches. They also say that net neutrality regulations would discourage them from expanding and upgrading their networks. "We continue to hope that any rules adopted by the commission will not harm the investment and innovation that has made the Internet what it is today and that will make it even greater tomorrow," Comcast Executive Vice President David L. Cohen said in a statement. But companies such as Google, Amazon.com Inc., eBay Inc.'s Skype and Facebook Inc. argue that without such rules, the broadband companies will become online gatekeepers that can prioritize their own online services or those of their business partners—and potentially put others at a disadvantage. Markham Erickson, executive director of the Open Internet Coalition, called Thursday's vote "the first step toward ... creating a framework that promotes innovation and consumer choice on the Internet." The Open Internet Coalition represents public interest groups and big Internet companies, including Google, Amazon and eBay. Genachowski's plan calls for the agency to formally adopt four broadband principles that have guided the FCC's enforcement of communications laws on a case-by-case basis. Those principles state that network operators must allow subscribers to access all online content, applications, services and devices as long as they are legal. The FCC relied on those guidelines last year when it ordered Comcast to stop blocking subscribers from using an online file-sharing service called BitTorrent, which is used to transfer big files such as online video. Comcast is challenging the FCC ruling in court. Genachowski also wants the FCC to adopt two additional principles that would bar broadband providers from discriminating against particular content or applications and require them to disclose network management practices. And he is seeking to apply all six rules across all types of broadband networks, including wireless systems, which have been largely unregulated. "The time is now to move forward with consideration of fair and reasonable rules of the road," Genachowski said Thursday. "It would be a serious failure of responsibility not to consider such rules, for that would be gambling with the most important technological innovation of our time." Some quick background. I'm 28 years old with no college. I am currently a Professional Services Manager for a small software consulting company. I have been with the company for over four years; I started as an entry-level developer and quickly converted to business analyst. My primary functions have included: working with new and existing clients to gather requirements, design software systems and document implementation plans, application testing, project management, and end-used training. When our director left two years ago, I took over (although I was only made "manager"). Since then I perform many of the functions I already mentioned, however I am also now responsible for managing a team of five programmers/analysts and managing all client projects at a high level (including resource scheduling). I got into this industry after high school by fooling around with Microsoft Access and learning relational database theory and a little programming. I have no formal certifications or training. Our team is working more efficiently and unfortunately the economy has slowed down our workload a bit. At this point, I would really like to invest in my future and I'm doing research on my options. I plan to attend Miami University of Ohio in the fall and I had thought I wanted to get a mac for college because I like the os and the physical designs better and apple's specs are always top notch. My dilemma is that for the business college (which is where i'm going) they recommend a pc. They say: The Farmer School of Business provides the recommendation to use HP laptops (PCs) over Apple (Macs) because it fits best into their learning environment. According to the Farmer School of Business: "There are many lab and project tasks involving specific software in which a PC is used to teach and is, therefore, easier to learn when away from class. It is not a requirement that a PC is used, but it is a strong recommendation. Students who wish to run Windows using Apple’s Boot Camp technology or in a virtualized environment (using software such as Parallels or VMware Fusion) may do so; however, if the Windows environment on the Mac does not properly run the software, students will need to seek their own solutions, as the School of Business does not have the resources to support the use of applications in these environments. I have been working in a recording studio and got laid off due to the business slowing down and over staffing. Now, my search for a new job in my field has become very difficult due to the economic troubles in US which have put many businesses in the same situation. However, companies like Apple, Digidesign, and Ableton offer great positions for programmers and software engineers proficient in C++. These are the same programs I am so familiar with and use every day. I have been in this relationship for six years, three of it married. When I met him, he was going through a bankruptcy for a dot com he had started after he left a mid level position at a software company. We lived in a little town at this point in time where the economy was not very vibrant and we made a fine living there, but only in comparison to the economics of scale. Both frustrated with what life had to offer us there, we moved half way across the country to a town of 70,000 people. He continued with the small business he had started and tried to make it grow - mostly with money borrowed on my credit cards. He racked up $13,000 worth of debt on a credit card of mine that I didn't even know that he was using. I was called by the credit card company because it had gone over limit with no payment. This was many years ago, and of course I was livid. But not livid enough to leave. I stayed and supported him in this business of his that has never turned a dime. I thought that he had finally come to terms with the notion that he saw that he was toiling away 60-70 hours a week at a business that was not worth it, but his ego has the best of him and he cannot see that it is never going to be a viable business. He keeps working on new ideas, going to venture capital conferences, etc to keep this thing alive - but in reality I support him. He makes less than a gas station attendant although he has an mechanical engineering degree and is a database website developer. It has been six years. I went $45,000 in consumer debt to finance this business. I make about $65,000 a year and can pay my bills without him, including the debt payments. (Although, if divorced I would hope that there could be some sort of payment plan, although I don't count on it since he hasn't been able to make payments on that debt while we are married.) The house is in my name because his credit was bad and I typically make the mortgage payment myself. The complicated thing is that I love this guy. We think on the same level, we both enjoy the same things. We are avid whitewater kayakers, back country skiers, and mountain bikers. He is funny and charming and I love spending time with him. But I have lost my patience concerning our finances, as I see that he is a bit of a lunatic in the belief of this business of his. The question is, do I leave or stay? I am leaning towards leaving as the definition of insanity is to keep doing the same thing and to expect different results and I keep expecting him to change - and I don't think he can. Oi! I want to move to Brazil in to become fluent in portuguese and to experience the culture and life there more. I would even consider living there permanently if i could find work. I did a study abroad there and absolutely fell in love with the whole vibe of Brazil. I'm going back for two weeks for Carnaval this year to check out Rio and Sao Paulo (the two cities I'm considering moving to). Five doctors have formed a partnership and are consulting my team and I for creating a network between the five offices. We will be using existing T1 lines to connect the offices but are not sure on the network and subnet design. Four of the offices are each about 15 miles from the central office, which has an existing LAN in place. Also, the east and west offices have existing LANs. All five offices have outdated hardware and software, so we will be replacing all of the computers with new systems running Windows XP. Each office will require ten computers, a printer/scanner/copier, and a fax machine. We will be using SUSE Linux to run the server. It will also be using Samba in order to work with the XP clients. We aren't sure which would be easier: if all of the offices should be on one subnet or if each office should have it's own subnet. We also plan on having Voice Over IP for each office. If it's all one subnet, then VoIP will be no problem. But, if we go with multiple subnets, should we get seperate VoIP services for each subnet? or have one VoIP provider on the central server? I should also mention that the doctors have not given us the job yet. Anyway, I got a project from a company. They had no money but promised me a cut of the revenues. I signed a standard confidentiality agreement, which is the only thing that I signed. I did not sign a work-for-hire agreement. The confidentiality agreement includes the following except: it will return all written Confidential and Proprietary Information received from the disclosing party and any documents or materials which discuss, incorporate or reference such Confidential and Proprietary Information upon the disclosing party's request to do so. Anyway, the project was completed. I had some delays due to the complexity of the application, misunderstanding of the requirements, a full-time job. Some clients and opportunities were lost, but I did finish the project. After I finished it, it languished for a time. Later, another opportunity arose that required additional changes to the software which I made, but after a few of these change iterations, I realized the return on my time is not sufficient and I started to push back. At this point, the owner wants me to turn over all the source code to him and to implement the changes that have been requested or he will sue me for all of the business that he they have lost. I have not provided any source code as I have provided hosting/equipment to the company for the company. He has a ultimatum that I must meet him tomorrow or he will file suit. He won't even give me time to consult an attorney. Can I be sued for missing deadlines for a project that just optimistic best guesses? I would do an estimate, and they would look at the project and tell me it was wrong, so my whole estimate was off. This happened several times. There was no project plan/documentation/manager. What about the source code, while I may provide the source code to them out of the goodness of my heart, since I can't use it, but am I required to give it to them?
