End of line for Bill Express empire

THE last remnants of the Bill Express empire have collapsed, with listed holding company On Q Group and privately owned Technology Business Systems placed in administration.

Retail king Gerry Harvey has also spoken about his failed investment in Bill Express, declaring he should be "flogged" for buying shares in the company.

On Monday, accounting firm Worrells notified the Australian Securities Exchange that it had been appointed voluntary administrator of On Q.

No announcement was made by the two remaining directors of On Q, Ian Christiansen and Julian Little.

Also placed in administration on Monday was Technology Business Systems, which is controlled by Sandro DiDonato a friend and business associate of Ian Christiansen and his recently deceased brother, Hal, who together ran Bill Express and On Q. more

CANADA-BASED exploration group Oilexco proved last week there was still plenty of oil waiting to be discovered in the North Sea. The company, which has been the most active driller in the region for the past four years, announced a significant find in its Moth prospect in the central North Sea, of which it owns 50%.

Drilling results were so positive that analysts now believe the field could hold at least 175 million barrels of oil. After last week's news the stock stands at 771p, but even at those levels it remains far short of analysts' targets. With oil prices expected to remain high, Oilexco is a good bet.

Open Question: Legal issues in software development.?

Basically after uni right now there really aren't many jobs going in software dev (that i can find anyway) so me and a few friends have decided that, after uni we're going to make our own hobbyist group. I recently decided to start my own online business once I had an idea for a website that could fill a huge untouched niche. I can't talk much about what it is about yet, because I want to patent/trademark/copyright whatever I need to beforehand. I have two areas I need advise on: 1- My main source of revenue in the beginning would be website subscriptions. I need some advise on how tax works in this situation. I want to set it up as a business, so that I can expand it more later, but physically there wouldn't be an office anywhere (at least at first), and I've heard that it is possible to get a lawyer or someone to help establish an online business in a state other than where I live in order to pay less for taxes. Is this legal, and how does it work? Is it advisable to do it if I really do want to have a physical office somewhere later on? My other question is about legalities. Does anyone know if it is possible to patent a website configuration, rather than the software that uses it? I will be purchasing the software I need to run the website, but I want to make sure no one else can come in and copy me. Also, how does Trademark work for websites? There really was not a correct category for my question. I hope someone here can help. A number of years ago, I filed for and registered a servicemark for my business. I have maintained this and the servicemark is still "live." Today, I see a number of businesses (about 10) around the country who have been using my servicemark. I realize that I have the right to "do something," but I would like to know if it is worth my while to do so, lawyers have asked for lots of money in the past to deal with one infringement, locally, and they warned me that I'd better hope it didn't go to court or I would be shelling out a whole lot of money pre-trial, say $20K or so and I didn't have it then, and certainly don't now....especially now, my being of more moderate means since the economy changed. What I mean is, I can't afford an attorney to go after each and every case of infringement. I do have a form letter to follow if I wanted to send one to each business in my name, but I don't feel that I would be as convincing as an attorney would be. Any suggestions toward helping me along to getting these other like-businesses to quit using my mark will be appreciated. Should I just send my form letter to cease and desist? Resolved Question: Civil suit - no job, no attorney or money can't afford any of it?

I recently found out I am involved in a civil lawsuit for a domain I purchased. I put a website up about how I was treated like dirt, and pointed gave other business addresses around the area to go to. I am not profiting from it, I don't know any of the business owners, I was just unhappy with the owner who sent me out in tears over him not accepting a credit card wanting me to buy a limit of $10, when I asked why he ripped into me and belittled me. Long story short, I put the site up. I'm now being informed as a result I'm being taken to court over the misappropriation of their domain name, violation of the their protected tradename, the disparagement of their business, as well as a claim under the Anti-Cybersquatting Consumer Protection Act, 15 USCA 1125 (d). I have searched the database, I can find no trademark. It's a small business, one small building with about 3 or 4 employees which are spread through a 24 hour period. My question is this, what do I do? I have no money, no job and can't afford an attorney. If a judgment is issued, I have nothing. I own no home, the only thing I do have is a car, and old car. There is no income to garnish, though my wife works. Can they garnish her for it? What happens if I have nothing to garnish? I read they could seize my bank account, which would net them all of about 20 bucks most days. Is this something I should have an attorney, if so is there an organization that would help with representation? I'm in Michigan if the state matters. more

Voting Question: trying to trademark my company name, but seems someone filed for a trademark for a similar name. HELP!?

i've been using my business name in general for he last 5 years or so. i've been using while doing business just within the last two years. i hadn't filed for trademark so far because i just couldn't afford it. when i ran a search for my company name on the USPTO website, it came up with one trademark waiting on approval for a very similar name. it went up for public dispute on october 26th, and will be up for dispute for 30 days from that date. is there anything i can do to stop their petition for trademark from being approved? for instance, if i can prove that i've been using the name and doing business under the name for longer than the applicant on file, will i take the greater claim? more

I have an LLC but I do business with a DBA. There is another company in the state who has an LLC with the same name as my dba. I was using the name first but now they are saying I have to give up the name. They do not have a trademark on the name however. Voting Question: What do I need to do to start a small General Contracting business?

Okay first the background information: -28 yr old male -Canadian, in the province of Ontario -Married -Finishing up second year of post secondary courses. (One was a building trades technology course, the other an HVAC technician course which helped me achieve my gas fitter level two tags) -Received OSAP funding for both years (approx 30k) I want to start a small business, specifically working with the first year course of Building Trades. I'm interested in doing some home renovations. Minor renovations to start and with hopes, expanding in the future to more major renovations. I already have a company name and slogan picked out, but unfortunately thats all. I'm going to need tools for start up and a work vehicle. I have no idea where to go from here. I don't know what to do to register as a business or what to do to get off the ground and I'm getting lost amongst the information I'm finding on the Internet. Do I need WSIB, GST or what? I was browsing trademarks on www.ipo.gov.uk website and decided to search wether some businesses in my local area have trademarks for te names...and i noticed one business(a fast food takeaway with over 8 branches) which had a trademark on its name and logo previously...but recently the owners revamped the business image and changed the name and logo and have not bothered to trade mark the new name. I have no idea where to start as far as that goes. I have a small product and know how to market. Now, say for instance, I started a company called organixbeauty and I sold organic make up that I make home-made. Let's pretend I want to protect that name and reserve it all over the web. So I do what I can...I sign up on myspace, twitter, youtube...make the email accounts, etc. But how do I protect that and keep others from copying/stealing/or using my formulas/ingredients? I'm just a nursing student who wants to make a few extra bucks to help pay tuition, so it's nothing serious..but I would hate for the idea to fly and someone pulls the rug beneath me. What can I do? I have been trying to start up an e-commerce business with a friend. My friend and I have had an amicable parting of ways. My friend had an artist friend of his draw 2 drawings to be used on the website as logo's. The artist drew the drawings free of charge. The drawings both state the artist's "nickname" on them and I do not intend to remove the "nickname" when published. local community group has program with 18 members volunteering their time, that will review my business plan and if interested invite me to present it. If they accept, I get a 1 year loan that I do not have to pay back for at least 1 year. Problem is the nature of my idea is very niche oriented and is relies heavily on strategic marketing / branding / pr initiatives - with no patents just a trademark.
