Open Question: General Partnership Troubles?

My husband went into a general partnership last year with his brother. Since then it has been a real struggle. Lets see, his brother lies, steals and treats my husband like he is a piece of dirt on the ground. The guy can’t even keep a mileage log and he stole $1500 out of the business account. He withdrawals money early and uses the business account for personal things whenever he wants to. I do the books, so at the end of this year it needs to be 50/50, so basically if he received more money than my husband did, does he need to compensate him for that? He used about $900 out of the account for personal things besides his pay. Well, my husband had his final straw today. He wants to leave the partnership in January, but his brother claims, he might let him work until then. Whether or not, doesn’t my husband get a 50% profit until he leaves? Can he leave or does the partnership have to be dissolved. Also, the brother/partner racked up $5,000 in credit card debt under the business name that my husband just found out about. And it was not used for business expenses either. Also, a company sold them supplies last year and after realizing it was junk his brother still installed it, but didn’t pay the company. we are selling our business, one person is purchasing the space from us and another is purchasing the building and equipment. The company taking over the space agrees on the price and has taken several steps to have things done and make sure they can legally move into the spot. This was first agreed on back in late May of this year. All is agreed but they are still hagling over their lease with the owner. question #1 should we have a letter of intent from them saying that as long as they get things worked out that they are going to purchase it question #2 should we have something from owner releasing us from our contract upon then signing their lease with new company? question #3 should we not let them do anything else to the property until we have that letter if we should get one? My boyfriend and I met 3 years ago. He had just finished a mutual divorce. They were junior high school sweethearts and from what I understand they only got married because they had been together for so long and it was "the thing to do next". They got married when they were about 25 and had been dating since they were 15. After the wedding the marriage went south and dwindled into a divorce. About a year after all of this, I met him and we started dating. He had lived separate from her for about a year already. Knowing the divorce was pretty fresh, I let a lot of things fly. He still had things stored at her house and still does. He still got mail there. They have 2 beautiful dogs that they both raised and love. I have been patient. It has now been 3 years since we started dating and I am "OVER IT!!" He still gets mail at her house, she is still the primary beneficiary on his life insurance plan ( not that I should be, I think he should at least change it to his mom ), we watch the dogs while she is out of town on business, their old house is STILL in his name, they share a car insurance plan and the place still doesn't know they have been divorced for quite some time now. He has lived with me for the 3 years we have been together, and helps me pay the bills. I have told him my feelings about this before, and he has reduced contact with her a lot, yet they still talk (which is fine) but I hate that they are still connected in so many ways. Now that Barack Obama is the President-elect of the United States and Joe Biden is the Vice President-elect of the United States; of course they are going to have to replaced in the United States Senate. Obama, a Democratic Senator from Illinois and Biden, a Democratic Senator from Delaware will probably resign their Senate seats shortly in order to go about the business of conducting the transition of power from President Bush's administration to an Obama administration. The Constitution of the United States permits the Governor of the state in which there is a senatorial vacancy to appoint a person to replace a senator who has died, resigned, been expelled (removed from office) etc. before their term would otherwise be up. Biden was re-elected to another six year Senate term (he ran his Senate re-election campaign in Delaware simultaneously with the Obama-Biden presidential campaign). My understanding is that the governor of Delaware will, once Biden officially resigns his seat, appoint Biden's replacement in the Senate. That person will have to run for the rest of the term if he or she so wishes in 2010. The governor of Delaware is fellow Democrat Ruth Ann Minner. She will need to appoint the replacement by Dec. 31st, otherwise on Jan. 1, 2009; the person who was elected to replace Minner as governor, Democratic state treasurer Jack Markell, will assume the governorship and then of course he would get to make the choice. Hopefully someone can give me some advice on what to do in this situation. Last year me and my then boyfriend decided to buy a pub. We set up a business, which he and I were directors of ( a third person had a small share as the company secretary). We took out a business loan for £22,000 (£15000 to purchase the business, £5,000 as working capital and £2,000 to pay off his outstanding debts). The cheque went into his personal bank account. Three days after the cheque cleared I caught him cheating and moved out of the pub where we lived. I told him that I would walk away from the business taking nothing as long as my name was removed from the loan and I would have no debt. (I thought this reasonable as I had received none of the money for the loan so I shouldn't have to make the repayments) A couple of days later he had my name taken from the business (without my consent) and is now refusing to release me from the loan as his credit score is not good enough to get a loan alone. To make matters worse he has not been making the repayments on the loan and I received a letter from the bank last week demanding £3000. I believe the government in Malaysia for whatever reason has censored any residential phone directory being made available on the internet, so is there a business or place in Australia that keeps an international, in particular, a Malaysian residential directory for the public to use? I have tried calling the international directory assistance line, but the operator was absolutely useless as they require at least 3 names and lots of very specific details of the person you are looking for (instead of just simply saying a suburb, first and last name), and quite frankly barely understood english. Open Question: HELP! We hired contractors, but they didn't fix what we hired them for!?

My mother is disabled in both hands and elbows and takes medicine to control the pain. She also takes medication for post-traumatic stress disorder. About 2 months ago she noticed a sound coming from the floor that implied water was leaking somewhere. I found the source of the leak (behind the faucet head) and bought a new one which fixed the problem. HOWEVER there was water damage to the floor, and where the tub meets the wall the floor started to decay. There was literally a hole forming in the corner of the floor outside the tub. A few weeks ago she called the city and they referred her to a company that specializes in mobile homes. They referred her to a company which then sent out someone to give her an estimate. We showed the person who came out the hole in the floor and he said they would have to take the tub out in order to fix it. The estimate they gave her was expensive, about $1,000 for a new tub, surrounding, underbelly insulation, and wood for the floor. They also quoted her at $65/hr/person for 2 people so $130/hr for 8 hrs!!! My mom is by no means a wealthy woman, and she already has a high level of stress/anxiety but agreed to have the work done. She put down $1,000 towards the work and on Mon. they came to perform the job. This is where things get tricky. The guy that came said we needed to rip the walls out in order for him to put the tub in properly. We reluctantly agreed to have him rip the wall out and I had to go buy some drywall to replace it. He also said he didn't realize there were 2 subfloors, so that before I could replace the linolium in there I would need to add more wood to level the replaced floor with the rest of the room. WTF?!?! I thought we paid this company to replace the floor, shouldn't it be level with the rest of the room? I had to work and couldn't stay there the whole day, so after I brought back the drywall I had to leave. After work I came back and they had the new tub put in, but THE HOLE IN THE FLOOR WAS UNTOUCHED. They cut about 3 inches from the wall right next to the whole and replaced a piece of the floor apx 3.5' x 5' WTF?!?! I brought this to their attention and he tried to say he told me he couldn't mess with that part, something to the extent that the floor goes to the wall and is supporting the wall/ceiling. He also tried to say that he told me that earlier, which he DID NOT. The whole purpose of them coming out here was to fix the whole by the tub. She didn't really want a new tub, only the hole fixed. She just got the tub because they had to rip the old one out so she figured why not. The guy kept saying things like "Well you obviously know more about carpentry than I do" and things to that extent. I only commented on the fact that the hole wasn't fixed which is why we had them out there, and that the floor should AT LEAST match the rest of the floor. ESPECIALLY for $130/HR!! I've been furious for the past 2 days. She only paid them half of what she owed them and they are to come out tomorrow to finish it. My question is if they don't fix the hole or make the floor even with the rest of the room, should she pay the last 25% of the bill she owes? The markup on the materials was rediculous. Not only that, they used MY drill, MY sawhorses, MY flashlights, and MY PVC tubing. At the end of the day they had the audacity to try to get my mom to sign a piece of paper that states no garauntee on the work they just did. She didn't sign it. ALSO she ordered a single-piece surround for the tub and paid for the single-piece, but they installed a 3-piece which is now bowing at the bottom and not lign up with the top corner. Also the top isn't a strait line because they cut it to fit so its kind of wavy across the top. Can I make the city pay for recommending this OBVIOUSLY unprofessional company? Under the Whois domain registration site it is showing the domain registered to UK, India and Beverly Hills CA. I tried to call the phone numbers to the CA. address and there all fax machine numbers. My niece who is 15 snuck a myspace profile she was not allowed BUT it happened. They phished her account and listed the profile with pictures and all on their dating siting site. We have sent over 200 emails followed their steps to remove the profile and we get no response whats so ever. This is happening to all ages. YES they should not be on MySpace I agree ok. BUT when you veiw their site it has ages 19 yrs to 80 yrs and 19 yrs and under tonnnnnnnnnnnnnnnnnssssssssssssssss of children under the age of 18 THIS IS A DISGRACE. I have been married now for almost four years and since we've had our second shild she is just NOT into havin sex. LIke almost never it seems. It will be spuratic. Recently she submitted an application for low income housing, however was not approved based upon several errors made on behalf of the actual housing authority representatives. One of the errors involved a miscalculation of income guidelines and yet another involved a missed appointment due to notification in the mail that wasn't delivered on time, thus my cousin was blocked from the program and told that the only way she could receive a hearing to appeal, was to gather a statement from the post office to demonstrate that the missing notice was not her fault. Also, there were several pieces of information on her application that do NOT match against the actual answers that my cousin provided and some even appeared to be changed so that any attempts to obtain housing were thwarted, however the housing authority is not holding anyone accountable for their deceptive business practices OR for their own errors in managing her case. She has contacted the supervisor as well as the post master general, but neither party was able to assist her any further, thus after waiting at least (5) years for housing, her name has been dropped from the list and she has to start all over again. I don't believe this is fair nor is it right. Please can someone provide me with significant advice on what she can do in order to appeal her case to a higher authority and how someone can hold the administrative representatives of the housing authority accountable for their own mistakes. This is not the first time this has happened and their is a tons of corruption and abusive use of power going on under the roof of this particular agency.
