Ok i'll point out now I have no understanding of high finance or big business but i was just wandering what the logic here is. Woolworths in the UK is £400 million or so in debt and from what I understand unless they can find a buyer the company will go under Surely the best way for the lenders (presumably banks) to get a return on there loans is to get together with the Woolworths board of directors and restructure the business's so that they can start to turn a profit and service there debts ,because surly if they close down then the lenders will have to write off the debt , Am I missing something here ?  more

Resolved Question: Law / Court question for UK.?

I don't know how to help a very good friend. She was given some money by a relative to start a business but 6 yrs later the business was dissolved with no money in it. There was a verbal agreement the money would be paid back but about 6 months later the relative told her she had no intension of asking for the money back as this was the amount she was going to leave her in her will. The elderly relative, I believe is 96yrs old has gone to solicitor saying she need this money for her care. My friend has responded to papers she was given at her home and attended a "Directions" hearing where she thought the judge would see sense and throw it out. She came back devastated as the judge has told her to "change her plea" but she can't understand why as she responded to the papers she had been given (a personal loan)and been very honest. Judge has told her it is going to Trial around April becaus it was actually given for a business but she says she's not going to bother and they can just find in the relatives favour as she is on benefits so she will not get a penny of the money back even if it goes against her. She is worried sick that the judge has not liked her honest response and asked her to alter it to make it look like she sort of embessled the money. She is thinking of leaving the country yet it is for approx £25k excl court costs. My friend has done nothing wrong and she can't afford legal advice so why extend this matter ? Q: Will there be a warrant out for her arrest if she does not appear ? She has already lost weight in the month since the "Directional" hearing - I think this is what she called it but I'm not sure. I'm really concerned for her health and well being as she is not normally like this. HELP I don't know how to help her and any suggestions I give her need to be 100% right so I'm not giving her bad advice. CAB say they can't help because it was a business debt not a personal debt. She cannot afford a solicitor to go with her to court and the thought of a trial is destroying her - literally. Please this is a serious question no flippant answers about should have got it in writing etc etc. What is the worst that can happen if she does not do what the judge said he gave her some dates to do things by but all she can remember is the trial in April. She says they can't hang her for it and debtors prisons don't exist anymore so what is the worst that can happen ? She is clearly worried deep down despite the bravado attitude. Meant to say she has worked all her life in banking and finance until recently when company started downsizing so you can see she has been in great positions of trust even a key holder I think and not on benefits all her life like I've made it sound. Explain what contempt of court is please ......? Can she go to jail as this is her worry and thinks she will never work in finance again? I can't believe this! My husband stole money from me! My husband is extremely abusive, emotionally, mentally, financially and verbally. Regarding finances, the first year we were together, he didn't work and I was the only one brining money home. He forced me into getting a loan and credit card for an imaginative business idea that would benefit us both in the future, then he took the credit card and loan off me and spent it on extensive shopping for himself and changing his mobile handset and cars every month. He promised to at least pay the minimum payments, but because he didn't have income, obviously he didn't pay back and I ended up with a huge debt (£20,000) and bad credit so my bank account was closed. My salary was going to his bank account and he spent it all, the only money I had was for train ticket to go to work. I was in love with him, so I let him get away with that, and thought I sacrifice myself for him so that he may change for my love. Then later on I got pregnant and couldn't work. We had to move in to my brother's house and we were at my brother's mercy for 9 months, during which my brother gave us pocket money. It was so infuriating and depressing but I couldn't do anything. My father sent me some money, I kept it somewhere to save, but realized the money was getting less and less every day, and he denied he was the one taking it. When the baby was born he had to go to work as my brother moved somewhere else. My maternity allowance and child benefit went to his bank account, during the past 15 months that I stayed at home with the baby and he is the one working, he didn't give me any money at all even for bus fare. So I was stuck at home, depressed and isolated. My brothers gave me some cash gifts worth £550 over 1.5 years that I saved hidden somewhere so that he couldn't find it and I kept in for emergencies in case my baby needs something. Eventually he found the place and my money started getting less and less and still he denied taking it. I was so frustrated and later he gave my money back. £550, claiming that he is doing me a favor and I was the one who lost it in the first place, but that's not true because I hid it under my bed in a safe bag. We are moving to US and I thought I can escape from him in US, so I sold all of my pre-marriage Gold that I saved through years, altogether I could create $4100. Yesterday he found it and stole $100 of it. And still he denies it. I can't believe he stole from me again. He wants to make me feel like crazy by denying it!!!! What should I do? Just to say, I can't stay in UK anymore, because with this credit history I can't do anything, and I couldn't extend my visa because he took all my money and i couldn't pay for university. Voting Question: Does credit scoring differ in the UK as opposed to the USA/Canada?

For some time now, I have known my credit rating to be poor, due mainly to youthful irresponsibility resulting in one default and several late payments. I recently purchased my experian report, and have obtained a credit score of 702, and live in Northern Ireland. I know that I'm unable to even obtain a contract mobile phone at present, yet much online literature seems to put 700 and above within the good credit category? I ask mainly because I may wish to take out a loan to start up a business within the next years or so, and am afraid past mistakes may have ruined my chances. I also have moved around alot, had several different addresses, several different banks and numerous jobs in the last 6 years, don't see myself ever being able to afford my own house, and have yet to find a steady job that will be able to sustain me until such a time as I'm ready to go into business myself, given my lask of formal academic or vocational qualifications and haphazard work history. I have purchased for that purpose in usa modern economics, corporate finance, financial accounting and mathematics textbooks with the complete set of supportive supplements (i was guided by the curriculums of usa and uk business schools and, partly, by the literature recommended for preparation to CFA exam) I consider that I have already reached the level of practical and theoretical foundation sufficient to start effective work in financial field. In medium term perspective I have set a goal to get a job in bank’s department responsible for financing bank activities. I consider that in order to achieve it, it will be indispensable to gain an experience in loan department, there are 2 reasons for that: 1. Loan portfolio is commonly the major part of the assets of commercial banks. Hence, the profound understanding of mechanism of its building provides the ability to evaluate the fair value of its assets and to find the ways of improving their quality. 2. Analysis of creditworthiness of potential borrowers implies intensive application of financial analysis, short-term and long-term financial planning methods, all that activity develops skills directly applicable to the process of making decisions regarding financing of the bank activities. I realize that I do not have considerable work experience on relevant position and certificate of degree by prestigious university. That is why exactly I have come to decision to write this letter. I wanted to focus your attention on my purposefulness and will to achieve significant results. The achievement of that goal is the task of paramount importance for me. Hi, We are looking to start and ECO property business (we feel this is definately the future of property in the UK). The problem is we only have 150K to start with, and its not really enough. In the meantime, we thought we could raise funds by buying small, cheap developments, or auction properties, doing them up and selling for a quick profit. My husband and I are trying to get a small business loan for either a LLC or INC. we want to start up. We have received an offer from Menkel Financial Group for the amount of 20,000. The problem with this is that the group is out of Jamaica (UK) which makes me a bit uneasy. I've tried to run it through the Greater Better Business Bureau (Menkel Financial Group 89 King St. West Jamaica WI 877-292-3584) but they only deal with the United States. They also want a 1500.00 disability insurance payment before the 20,000 is deposited which sounds funky to me as well. In 2004 i bought a pub. It turned out to be a big mistake. I had to walk away loosing a lot of money in the process. i have started a new life with my wife in France. I work in the middle east and earn quite good money. My wife and I mortgaged her house in the UK to raise the money to make a cash payment for our house in France. When we left the pub there were some debts most notably to the bank and a brewery loan. The bank had first charge over the property, but as far as I know have not been able to sell it. Behind them were the brewery who had given a loan secured on the property behind the bank. Now both the bank and the brewery are writing to me claiming money I dont have. I did not go bankrupt and the business was done through a company however the bank and the brewery both say I signed personal guarentees to the loan and mortgage.. I have no assets in the UK. The wife's house is up for sale, but the mortgage is in both our names. Advice please.  more

Rediware Ltd is a small textile company based in Salford, UK. The company has been operating for 30 years and has enjoyed a slow but steady rate of growth over that period. The company was started by Antonio Sardu, an Italian immigrant, and was managed by him up until 31 March 2000. The company employed 30 workers (mostly female) and supplied a limited range of children's wear to clothes shops in Lancashire and parts of Yorkshire. Antonio estimated that school shirts and blouses accounted for approximately 60% of the total turnover of the business. Over the years the company had established a solid but unexciting image amongst its customers. The clothes provided were well produced and durable but rather traditional. In the years leading up to 2000 the company had been growing at the rate of approximately 4% per annum. On 1 April 2000 the company was taken over by Antonio's son Guiseppe. Guiseppe was twenty-six years old and had acquired a degree in law. He worked for four years for a multinational oil company, as a trainee marketing manager and later as a marketing manager for a brand of engine oil. Although he was enjoying some success in his chosen career, Guiseppe began to find the prospect of running his own business increasingly attractive. Upon graduation he had made a conscious decision not to join his father's business immediately, partly because he wished to be independent and partly because he wanted to acquire a wider experience of the world of business than Rediware Ltd could offer. However, when his father announced his intention to retire, Guiseppe decided that he would like to take over the business and run it in a way that he saw fit. Antonio Sardu was delighted by his son's decision and during the last six months of his management he tried to provide as much information and advice on the business as possible to his son. Guiseppe found his father's advice useful but soon decided that the company needed a change of direction. He felt that the image that it had acquired over the years was a real barrier to significant growth. He believed that real growth could only be achieved if the company became more attuned to the changes that had occurred in the children's clothes market in recent years. Children were becoming fashion-conscious at an earlier age and were exerting an increasing influence on their parents' buying decision. Guiseppe also felt that the retail outlets that the company supplied in the past were unlikely to be an adequate base for future growth. Most were small owner-managed retail businesses that had suffered for some time from the general effects of an economic recession, which had a bad effect on the size of the children's market, and from the specific problem of increasing competition from large multiple stores and mail order operations. On taking over, Guiseppe commissioned a leading fashion designer to design a new range of children's clothes for the company. Within a fairly short period, the designer created a range of nylon leisurewear/sportswear clothes using bold primary colours for children in the 8-12 year age group. Guiseppe was excited by the new range and, through a former business associate, arranged for a buyer from a large chain store, Beta plc, to inspect the designs. The buyer was impressed and, after some negotiation, it was agreed that Beta plc would purchase the new range of products for sale through its stores. The contract from Beta plc was for £310,000 in the year to March 2001 and £455,000 in the following year. At the end of the year to March 2002, the fashion designer was commissioned to create a new range of products for the company as it was felt that the existing range had come to the end of its life cycle. The new range was also received with enthusiasm and it lead to orders from Beta plc worth £390,000 and which were for delivery during the year ended March 2003. Rediware Ltd continued to produce its more traditional range and to supply it to established customers as well as fulfilling the contracts with Beta plc. However, this customer base was not growing as the contracts from Beta plc placed a considerable strain on the production capacity of the company. In order to meet the conditions of the contract with Beta plc, it was often necessary to reschedule other work and so established customers were often subjected to delays in delivery. This led, inevitably, to a loss of goodwill and lost sales. Although Guiseppe made some attempt to satisfy the traditional customers, he felt that it was necessary to give priority to Beta plc in order to achieve the growth that he wanted for the company. Nevertheless, he did feel that some increase in production capacity would be required as he was hopeful that the contracts from Beta plc would increase over time. Under Guiseppe's management, the company had begun to replace some of the older equipment in the factory but to increase production capacity significantly, more new equipment costing £540,000 was required. In addition, more factory space and storage facilities were required. The existing factory could be extended to meet these requirements at an estimated cost of £72,000. To finance this expansion Guiseppe was considering either the issue of new equity shares or taking out a long-term loan. The accounts of the company over the last three years were as follows: Extracts from profit and loss account for the year ended 31 March Balance sheet as at 31 March A subsidiary of the multinational oil company for which Guiseppe previously worked was now a major supplier of nylon material to Rediware Ltd. He had close contact with their senior management before and since taking over the company from his father. The subsidiary, Nymax Ltd, had for some time, been interested in identifying suitable investment opportunities. Guiseppe was aware of Nymax's interest in making some outside investments and proposed that the supplier should make an investment in Rediware Ltd for an amount equivalent to the cost of the proposed expansion. This would represent a new activity for Nymax Ltd, which had previously made no outside investments. In April 2002, Guiseppe entered into serious negotiations with the senior management of Nymax Ltd. During these negotiations he supplied the following unaudited forecast profit and loss account for Rediware Ltd for the year ended 31 March 2003. Forecast profit and loss account for the year ended 31 March 2003 This forecast statement was based on the assumption that the new equipment and additional factory space would not be acquired and, therefore, Guiseppe argued that it should be considered a conservative estimate of future profits. At one of the meetings with the senior management of Nymax Ltd, Guiseppe supplied details of the contract with Beta plc. He also informed the managers that the current market value of the freehold property was £610,000. Guiseppe made it clear that he would prefer that any investment from Nymax Ltd should take the form of new equity shares. At present, the shares in Rediware Ltd were held as follows: After consulting with the other shareholders, Guiseppe offered to issue new shares in the company to Nymax Ltd at a price of £68 per share. Alternatively he was prepared to accept a 12% loan that would be guaranteed by Mr. Antonio Sardu and which would be repayable in equal annual instalments over a five-year period. Nymax Ltd was given two weeks to consider the proposal. The accounts of Nymax Ltd for the year ended 31 January 2002 were as follows: Extracts from profit and loss account for the year ended 31 January 2002 Balance sheet as at 31 January 2002 You are required to: a.Evaluate the financial position and performance of Rediware Ltd for the three-year period ended 31 March 2002. b.Evaluate the investment proposals made by Guiseppe Sardu from the perspective of Nymax Ltd. c.State what other factors need to be taken into account before a Nymax Ltd make a final decision.  more
