Forfeiture and the Sixth Amendment: From Drug to White-Collar Cases?

"The Kaleys simply want to use their own money to retain counsel of choice to defend them at trial," said one of their attorneys, Howard Srebnick of Black Srebnick Kornspan & Stumpf in Miami. "The government is interfering by freezing their assets, including the equity in the home they purchased more than a decade ago, without giving the Kaleys an opportunity pre-trial to confront witnesses and present evidence to establish they have committed no crime." The Kaleys, according to the report, set aside about $1 million to pay attorneys by taking out a second home mortgage and cashing certificates of deposit. But prosecutors claimed the money was ill-gotten gains. They charged Kerri Kaley stored the medical equipment in the family's garage. more
Community leaders seek new byway to complete Rainier loop
Steve Pruitt of the Eatonville Chamber of Commerce says a West Rainier Byway would encourage more visitors to explore the area, boosting tourism.
Community leaders from Enumclaw, Buckley, Orting and Eatonville are involved. They've written to the state Department of Transportation, saying they're interested in connecting to the Chinook Scenic Byway, the White Pass Scenic Byway and State Highway 7.
The group plans to meet with Washington state transportation officials.
Carrie Sunstrom, coordinator of the state Scenic Byways Program, says her office is exploring this route because of its potential to form a loop trip.

When United Way of Greater Eau Claire serves up the outdoor culinary celebration again on Sunday in Phoenix Park, Jan Porath would like to see attendance grow to more than 15,000.
"It's just something different that people can take part in that's very family-friendly," said Porath, United Way director of communications.
More than 30 restaurants, caterers and specialty food shops will showcase their products. Most will sell sample-size foods, which require one to five tickets. Each ticket costs $1.

Ohio House passes bill requiring government business be in English
The Ohio House today passed a bill requiring government business, such as meetings, to be conducted in English.
The measure passed by a vote of 54-42 over the objections of lawmakers talking about the Statue of Liberty to argue the bill contradicted the country's heritage as a land of immigrants.
It was also opposed by the American Civil Liberties Union of Ohio, which said the bill will lead to litigation and make it difficult to attract innovative companies.
''English-only policies are misguided and divisive,'' said staff attorney Carrie Davis in a statement. ''People want to learn and improve their English, but the demand for learning classes outpaces their availability.''
Proponents of the bill said it would improve efficiency in government offices if they only have to conduct business in one language. more

As an international Chinese student in the United States, I believe that I have a great deal of business, academic, social, and cultural experience that will allow me to fit in well and contribute to the international flavor of Lund University. One of my most distinguishing characteristics is the diversity of experiences I possess. I am a business student with a flair for the arts. I am a woman with technical aptitude and an interest in entreprenership. I also have a passion for traveling and understanding different cultures of the world. All these elements have given me a very broad outlook, with varying degrees of knowledge in a range of topics. I strongly believe that although some are not related directly, all these qualities will influence my graduate work. My Business degree has given a strong foundation to my analytical skills since business issues research involves a lot of complex and intricate relationships among parties who are aiming at different goals, and the application of basic math, communication and psychology skills. Over the past four years in college, I have been working part-time with my own business, Shining SIM Card, set up when I just became a college student. I was the president of student government and am also an active member with SSE - Siemens Solar Energy. I have assisted my father in his project to supervise and monitor the process in his company during my breaks. More than what I have studied in school and college, it has been these experiences that have shaped the person that I am today. I believe that this unique blend of experiences has made me a woman with an original point of view. The more I think about it the more I like it. Let's divide the US into Liberals and Conservatives. We've become like a party of hikers stranded on a mountain slope. Both sides could be right, both are willing to stake their lives on their ideas, and both are ready to kill the other side for resisting what must be done. So, let's split up. The Liberals get the Northeast and both coasts: the blue states. If we get all the blue states from 2008, that includes New Mexico, Colorado, and Florida. Also, Hawaii. I'd throw in Florida for the Conservatives just to sweeten the pot. I suggest we name ourselves the Social Democratic States of America. The SDSA. The Conservatives get the big center of the country and the gulf coast states. And Alaska. I suggest you call yourselves the Christian Confederation of America. The CCA. During the partition there will be some messy splits, and a lot of dramatic exoduses and ethnic cleansing. Most of the city of Austin will be Liberals trapped far behind enemy lines, in the very Capital city of the Christian Confederacy! They will have to evacuate to North Carolina. Conversely, the entire population of Western Michigan will have to make a run for Missouri. A lot of Wall Street guys will be flying their private jets one - way to Dallas, while a lot of Liberal millionaires will say goodbye to their Montana ranches forever. We have to split the federal debt and each pay off half, because both Rep. and Dems have borrowed all that money. Right now national debt is 12.9 trillion. A little less than half of that added up during the administration of Pres. George W. Bush (sorry, just had to point it out). The Christian Confederation will eliminate income and business taxes, but they still have to find a way to pay back $6.5 trillion without that revenue. Take State revenues in Texas, the capital of the CCA. They make $21 million a year in sales tax and $26 million in income tax. Without income, sales tax will go to around 20%. However, no one will have any medical, prescription, or education expenses. We each get half of the military, because we both paid for it. The Border Patrol in the Tucson sector has arrested at least 261 Chinese border-crossers this year, compared with an annual average of 32 during the last four years, officials said. "They are the main (non-Mexicans) we catch," said field operations supervisor Juventino Pacheco of the patrol's international liaison unit in Nogales. "Lately we have been catching more Chinese than Central Americans." When agents find Chinese migrants — hiding in gulches, perhaps, or huddled in smugglers' vehicles — they often request help from Dean Delap, the sector's only Mandarin-speaking agent. He taught and studied in China, but had not expected that to prove valuable in Nogales. "Some are cooperative," Delap said. "Some are scared. They've just been arrested, they are in a new place. I put them at ease." Chinese remain a small fraction of the overall number processed at the Nogales station — which guards 31 miles abutting Nogales, Mexico. He told the Institute of International and Strategic Studies that the formula, which is favoured by Vice-President Joe Biden, would lead to "Chaos-istan". When asked whether he would support it, he said: "The short answer is: No." He went on to say: "Waiting does not prolong a favorable outcome. The remarks have been seen by some in the Obama administration as a barbed reference to the slow pace of debate within the White House. Yet many in the US and abroad are impatient with the pace of progress under the Obama administration. The president made the rounds on five news talkshows on Sunday as he pressed his policies and vision, preparing for what is likely to be a difficult week. Besides the ongoing battle over healthcare, this week sees two showdowns between Europe and the US that will reveal further slippage in American global leadership. The first showdown comes today at a UN special session on climate change in New York City; the second will come at the end of the week at the G20 meeting in Pittsburgh, where America and Europe will butt heads over financial system reforms designed to ensure that the AIGs of the world can never again cause an economic collapse. Europe has been increasingly critical of America's failures to live up to its global responsibilities. The US is not only the world's largest emitter of greenhouse gases but is by far the largest per capita emitter of carbon and other pollutants. China comes close to the US in terms of total carbon emissions, but it has four times more people, who each belch far less individually. Europe, while having much the same high living standard, has an "ecological footprint" that is only half of America's, since Europe has taken leadership in implementing renewable technologies and conservation practices. On the campaign trail, Barack Obama promised to reverse the Bush administration's terrible ecological record. Yet so far the world has seen more symbolic gestures from the Obama administration than accomplishments. Its biggest achievement so far has been an example of disappointment. President Obama signed an executive order to increase US motor vehicle mileage standards – but only to a level that will push fuel efficiency by 2020 to a level that European and Japanese cars reached several years ago, and even China has already achieved. Europe has announced donations of $2bn to $15bn a year for the next decade to help developing nations cope with climate warming, yet the Obama administration has not offered anything close to that amount. Europe also wants binding, near-term targets for developed nations, proposing a 20% reduction from 1990 levels by 2020, or 30% if everyone agrees. The Bush administration of course rejected such targets – but now it looks like the Obama administration is not willing to go any further. It has said such targets should be voluntary but verifiable. With the US Senate is bogged down in the fight over reforming healthcare, American leaders have said that the senators might not move on climate legislation until 2010, well after the global climate change conference in Copenhagen in December. That drew a sharp response from John Bruton, head of the European Union delegation: "The United States is just one of the 190 countries coming to this conference," Bruton said, "but the United States emits 25% of all the greenhouse gases that the conference is trying to reduce. I submit that asking an international conference to sit around looking out the window for months, while one chamber of the legislature of one country deals with its other business, is simply not a realistic political position." We also felt Him leading us toward international adoption. Both our families thought we were crazy (and probably still do), but we began gathering information from adoption agencies. We finally decided on Children's Hope International, and we are so grateful we did. We went to an informational meeting in 2003 and learned how much money we would need. We then started working toward that goal. Little did we know that we would come across job difficulties and other financial strains, but God was in control. In May of 2006, we felt that we were almost there, and we went back to Children's Hope to get updated fee information, and to find out what paperwork we would need to gather. My wife was starting a home business, and we wanted to get that going before we applied so she could be a stay home mom. Banks and their regulators want to turn that notion on its head so they can spin a smooth tale of how they would like things to be. Sadly, some accounting rule makers may be ready to appease banks and the politicians who back them. If that happens, financial results will change from a vital tool for investors to a vehicle catering to managers, regulators and employees. This would undermine the idea that the needs of investors drive markets, replacing it with a more corporatist outlook favored by companies and politicians in continental Europe and Japan. In other words, the goal of providing unbiased, impartial information about a company’s worth would be trumped by a company’s business model and the broader needs of the financial system. This battle over financial reporting is playing out in the debate over proposed accounting rules for how banks value things such as loans and bonds. The International Accounting Standards Board is hoping to have new rules in place by year-end. The Financial Accounting Standards Board in the U.S. is moving at a slower pace, though the boards hope to eventually agree to similar rules. Both groups have come under fire from banks and regulators in the past month, although the IASB has drawn the most heat. That’s happened even though the IASB has already bent too far to please the industry. Listen to Government In late August, French Finance Minister Christine Lagarde wrote to the European Commission decrying some of the proposed rules while saying the independent IASB must be made “more responsive” to government wishes. No. 1 Audience The rules should also “improve the decision usefulness and relevance of financial reporting for stakeholders, including prudential regulators,” according to a document issued last month by the Basel Committee on Banking Supervision, a group whose members are central banks. In other words, investors should no longer think that they are the main audience for financial statements. The practical result of such approaches would be to allow banks to report smoother results that supposedly reflect their long-term prospects. For banks, smoother profits would presumably lead to higher share prices. For regulators, less volatile results would supposedly make it easier to maintain financial stability. The problem, as investors know, is that life, and markets, aren’t smooth. Conditions change, as do financial values. Because of this, investors need financial statements that provide information about the current state of a company’s business and worth. The past two years, replete with unexpected failures of supposedly solid firms like Lehman Brothers Holdings Inc., have shown how vital that is. Creditors Count Plus, investors aren’t just shareholders. They include creditors such as bondholders, who need to know what a company is worth today in case it goes under. Banks argue that their intent should matter. If a bank plans to hold, rather than trade, a security, it shouldn’t have to worry about daily fluctuations in its value, they say. Both the IASB and FASB have given ground to this business- model view, although the FASB’s changes aren’t as onerous for investors. The IASB, on the other hand, wants to give banks more chances to show holdings at their historical cost. In doing so, it also plans, unlike the FASB, to allow banks to completely ignore changes in the market value of some securities. This may result in banks reporting puffed-up equity, giving investors a false sense of comfort. Two banks, for example, may hold the same AAA-rated security, which has fallen, say, $5 from a face value of $100. One might report a value of $95, the other, $100. America has an economy larger than the next four countries combined encompassing nearly a quarter of world GDP. While the population growth of the world is slowing and in some places declining, America is growing and will continue to (possibly at a faster rate as the baby boomers retire due to a lack of working age people to fill labor demand and a need to bring in immigrants to fill those jobs) because it relies on immigration for its growth rather than births and it has a massive country with a low population density and plenty of room to expand (Some estimates place the U.S population at a billion by 2100). It has the strongest military in the world by far and is impossible to invade due to its overwhelming naval power and the fact that it is seperated from the rest of the world by two massive oceans. Because it cannot be invaded (and suffer damage to its civilian population and infrastructure) the U.S actually becomes stronger through war because war creates urgent demand for military research and the results of that research generally has commercial uses. An interesting phenomenon has been occurring ever since the U.S became the most powerful country in the world around 1900. The number of nations in the world more than tripled in the 100 years between then and 2000. I believe this is because the U.S fears the formation of empires capable of matching U.S naval power (Thus capable of invading America), which explains its support for self determination and its frequent international interventions. As nations fragment the comparative power of the U.S rises and the U.S ability to intervene internationally increases further. I see this eventually leading to a world to fragmented to oppose the U.S. Read the below before posting if planning to use an emerging superpower overtaking the U.S argument ................................................................................................. This leaves only emerging powers as challenges to U.S power. The E.U, China and India are the most commonly stated examples of "superpowers" on track to take U.S supremacy. I think its for the most part media hype. The E.U is a supranational body which is composed of nations with very different languages, histories, cultures and interests, it has no army, the people of many E.U nations are hostile to it and growing more so and to finish it all off, Europes overall population is falling. China has a specialized economy based on export because its population is to poor to buy its own manufactures, this makes it extremely vunerable to fluctuations in the world market. If the world enters recession it hits China the hardest, if the price of oil goes up so does the cost of China's goods and China is in an export business with plenty of competition. Mexico is wealthier than China but its closer to the U.S, meaning if China's workers wages increase just a little foreign competition'll wipe out its economy. China has avoided that scenario thus far and grown rapidly because rather than grow from increasing wages and internal consumption, its grown from bringing people from its impovershed interior to the coast. The problem with this is that China will eventually hit the wall. Lastly China's centralized bank uses subsidized credit to keep inneffiecient businesses alive so as to keep their workers employed and happy with the government. The problem with that is many of China's businesses can't pay back those loans and its been estimated as much as 25% China's economy is bad loans. India I can see getting to be strong but I can't see it being a superpower because its population is getting way to big and theres a point where it becomes a burden (High food prices, lack of drinking water, massive gov't welfare programs). It also is very internally divided with much power being based in its individual provinces because of its many different language and ethnic groups. I one of JW's see things happening but quite naive on who really to contact in government to focus on something Jehovah's Witnesses have known for many, many years now and now the Pope is taking action right at that area we have been saying will come some day. We seem to be the only ones understanding what Revelation is saying about the United Nations and religion in special sign form. And now the Pope wants to give teeth to the U.N. which is sad and funny at the same time knowing what we know. The U.N. Revelation shows is to be given power to take all religion has away from it that mix in government which is a sin by Bible law. Those religions that like to control what government does by forcing their ideas into human laws is a sin. We see religion doing that daily in the news now. JW's only go from door to door but not mix in government to force our religious ideas into human law on you. We use the constitutional laws to fight for our religious civil rights but peacefully in courts not by war or by mixing in government. So there is two kinds of religion at conflict in the way they do things. Those who give you free will choice by coming to your door and those who try to force their will on you by mixing in human law. U.S. Attorney Benton J. Campbell said the reward money and new federal charges were among U.S. efforts to dismantle a powerful drug trafficking organization known as The Company, whose members came from an elite security force called Los Zetas. The only name on an indictment unsealed in federal court in Brooklyn was Miguel Trevino-Morales, a fugitive charged with operating a continuing criminal enterprise, international cocaine distribution and firearms violations. The indictment also sought the forfeiture of $1 billion in drug proceeds. Campbell said in a release that Trevino-Morales, who could face life in prison if convicted, was the principal leader of Los Zetas, a group that includes former members of the Air Mobile Special Forces Group of the Mexican military who went into the drug-smuggling business. In Washington, the Department of State announced it was offering a total of $50 million for tips leading to the capture of the defendants, including four leaders who were designated as narcotics kingpins by the U.S. Department of the Treasury's Office of Foreign Assets Control. The government said it was offering up to $5 million apiece for information leading to the arrests of 10 people, one of whom has been captured. Nineteen defendants have been charged in an indictment in federal court in Washington with drug trafficking-related crimes, and others are charged in indictments in federal court in Houston. "The joint efforts announced today are significant steps in the department's strategy to stop the flow of illegal drugs into our communities and the shipment of drug proceeds back to Mexico," Campbell said. Assistant Attorney General Lanny A. Breuer said the actions taken Monday will at least make it more difficult for the drug dealers to move cash around. "We have learned that the most effective way to disrupt and dismantle criminal organizations is to prosecute their leaders and seize their funding," she said in a release. "We stand shoulder-to-shoulder with our brave Mexican colleagues in the fight against these destructive cartels." The Foreign Narcotics Kingpin Designation Act, which became law in 1999, prohibits all trade and transactions between U.S. companies and individuals and significant foreign narcotics traffickers, their organizations and associates who act on their behalf. Fewer than 100 people have been designated narcotics kingpins since the first major targets were announced in June 2000. The indictment unsealed in Brooklyn said the drug organization, formerly known as the Gulf Cartel, had become the dominant force in the drug trade along the Gulf of Mexico, transporting multi-ton quantities of cocaine each month from Mexico to Texas after obtaining it in Guatemala, Colombia, Venezuela and elsewhere. So I was looking into Master programs, but am unsure if I should rather do the Master of Applied Finance or the Master of International Business and what opportunities these degrees might lead to. Even though I have a Bachelors in Finance, I thought it was really hard and has not done me any good. So I am not that inclined to do Finance again unless it's really worth it.
