The copyright holders involved can't sue anybody. The GPL's sec 2(b) only requires distribution of source code to "all third parties": "b) You must cause any work that you distribute or publish, that in whole or in part contains or is derived from the Program or any part thereof, to be licensed as a whole at no charge to all third parties under the terms of this License." All copyright holders that contribute code under the GPL are "offerors" and not "third parties" therefore, the "offerors" suffer no injury and hence have no standing to sue. Daniel Wallace has told everyone about this fact for years. You can't sue someone over another party's alleged injury --- only the person "injured" (in this case "third party") has standing to sue.

3 businessmen barred for life from doing business with city of Chicago

Only hours after the city of Chicago barred three businessmen convicted of contract fraud from doing business with the city for three years, a key official changed his stance Thursday and barred them for life.

In his about-face, Chief Procurement Officer Montel M. Gayles said his initial notice of a three-year ban for the men did not accurately reflect an earlier decision by Mayor Richard M. Daley's administration for a permanent ban.

He also said he had not fully realized he had the power to order the more severe punishment.

"Based on further discussions with our law department, it has become clear that I have the authority to implement a stronger penalty," Gayles said in a statement. "Based on our review of the facts, we will work with the law department to move forward with the permanent debarment as planned."

James Duff, whose family has raised money for Daley's campaigns, was sentenced to nearly 10 years in prison in 2005 after pleading guilty to racketeering and other charges. more
