I have a small computer repair shop. I operate on tight tight finances and my policy has always been that any hardware sold has a 30 day replacement or repair warranty, and there is no warranty on software. I have had many happy customers buy computers from me and have computers repaired with me. I only accept cash, because there is no chargeback risk as with credit cards or checks. Recently I had a customer purchase a laptop from me, bring it back and say she is not happy with it. Claims it will not play video games her son wants to play on it. I told her it is not powerful enough. (Not enough ram or processor speed). There is nothing wrong with the computer. I can't afford to refund her but she claims its illegal to not refund money. this is for my canadian law course. Brown, a university student, owned a small automobile which he desired to sell for $800. He placed an advertisement in the university newspaper offering the vehicle for sale, and included his telephone number for further information. A few days later, he received a telephone call from a man who identified himself as Mr. Green. Green asked Brown a number of questions concerning the car, and then expressed a desire to examine the vehicle. A meeting was arranged for later that evening, and Brown gave green the opportunity to test drive the automobile. Green agreed to purchase the vehicle for $800 and offered Brown a personal cheque bearing the name "R. Green" as payment. Brown was reluctant to accept the cheque without additional identification, and suggested the two men meet the next day at Brown's bank to conclude the transaction. Green explained that doing so would be impossible, as he was leaving town on business that night. Instead, he offered a driver's license and a number of credit cards bearing the name "R. Green" as evidence of his identity. He offered to leave his credit cards with Brown as security. With some hesitation and concern, Brown signed the blank motor vehicle registration and handed Green the papers necessary to transfer the ownership. Resolved Question: Civil suit - no job, no attorney or money can't afford any of it?

I recently found out I am involved in a civil lawsuit for a domain I purchased. I put a website up about how I was treated like dirt, and pointed gave other business addresses around the area to go to. I am not profiting from it, I don't know any of the business owners, I was just unhappy with the owner who sent me out in tears over him not accepting a credit card wanting me to buy a limit of $10, when I asked why he ripped into me and belittled me. Long story short, I put the site up. I'm now being informed as a result I'm being taken to court over the misappropriation of their domain name, violation of the their protected tradename, the disparagement of their business, as well as a claim under the Anti-Cybersquatting Consumer Protection Act, 15 USCA 1125 (d). I have searched the database, I can find no trademark. It's a small business, one small building with about 3 or 4 employees which are spread through a 24 hour period. My question is this, what do I do? I have no money, no job and can't afford an attorney. If a judgment is issued, I have nothing. I own no home, the only thing I do have is a car, and old car. There is no income to garnish, though my wife works. Can they garnish her for it? What happens if I have nothing to garnish? I read they could seize my bank account, which would net them all of about 20 bucks most days. Is this something I should have an attorney, if so is there an organization that would help with representation? I'm in Michigan if the state matters. more

Voting Question: Do you think the time has come for Americans to just accept the fact that??????????????

when it comes to our lavish lifestyles and our health care, we are simply going to have to accept less? In order to stabilize the economy, we need to spend...but not by using credit cards as that will only create an even bigger problem again later. We will have to learn to live within our means...but that will mean that probably a third of all companies will go under and those people will be out of work. So what's the answer? Either they need to cut our taxes...which they won't do as long as the government insists on spending so much...or we can't start spending what we earn. And even if taxes are cut, if we don't use credit cards, all those folks will be out of work. Basically, the only thing the government can really do if they choose is to lower our taxes and lower the taxes on small businesses so that we spend more in those small businesses to keep them going. But that means, the government will either have to tighten their belts or go further in debt. more

Resolved Question: Good or bad: Take $8,000 loan to pay off smaller credit card debts ($4,000) to only pay 1 bill/month?

Just calculated all my CC debt and I have a grand total of $2450 in debt. I also have to pay tuition next semester which will be another $2,000. So $4450 total. This CC debt is hanging over my head and annoying. I just want to get rid of it once and for all! I have been offered a loan of $8,000. My minimum balance per month would be $280. I would take the $8,000 to pay off the $4450 debt which leaves me with $3,550 in my bank account. With that $3,550 + my current bank account balance + work I will pay the $280 per month. ...Then I will not rip up my CC cards (3 total) but I will just straight up not use them. Actually my highest balance is on my Best Buy store card (bought a laptop, a desktop, and an HD Canon over the last 6 months)..... So do you think it is a good idea to do this? I do because I will pay off and "consolidate" all my debt into one payment a month. Instead of worrying about 4 due dates I'll just worry about 1....Not to mention this loan will boost my credit score and report (which is good so far, not one missed payment or late payment, staying below 35-40% of my max credit limit at all times).... Here is the good part. I recently was approved to buy a foreclosed home. I believe I can get (renting it out) $800 a month. The problem is I am waiting on the bank to get the paperwork together so I can use my money from my checking account (yes I have enough to pay off all my debt listed above + way more) BUT I want to use this money to pay for the house THEN LATER when the house is paid for + repairs worry about the $2,000 in debt. It has been a few weeks since the bank accepted my offer and I am hoping any day now they will have the paperwork ready so I can get a tenant in there. So the good news is (hopefully just before Xmas) I will have an extra income of $800 a month which will by itself pay for more than the min. balance of the loan each month. Since I said I would have roughly $3550 of the loan money left after I pay my debt I will use this + the first months rent + the deposit from my tenant to pay a large chunk of that $8,000 debt off (probably $6,000). Then from that point I will go on with my life and business and only owe $2,000 on the $8,000 loan which I will pay off quickly. Now I spoke with the lender and they said if I paid the loan early I would barely pay any interest whereas if I pay over the life of the loan I will pay the full interest. ...Then several months down the road I will try to talk with my bank on getting a home equity loan (to use to buy a second foreclosed home)... In fact, three-quarters of bank revenue on supposedly free checking accounts now comes from overdraft fees. That's why it's called "fee checking" in industry lingo! One of the most controversial practices among the giant banks concerns their overdraft systems. They won't allow you to opt out of the loop where they approve debit card transactions knowing you're overdrawn just to fee you. Bank of America has now increased the maximum amount of its overdraft charges per day to $350. Don't adjust your computer screen…that's $350, according to The Washington Post. If you're in danger of running in the red with your account, then you need to rethink everyday spending. Go old-school -- live a cash-only lifestyle and swear off the debit card. Add your comment Avg. rating: N/A bank fees What has biten me is our checking account, 22 years old with same bank, same address, nothing has changed, and we had a problem, a payment done on line for $1100 appeared not to post, so I did it again, I called the bank and told them to not honor both if both were presented for payment as only one should have, (same amount, same debtor also for over 4 years), well both got drafted out, and we were continuing as usual with our debit card, making purchases, even purchases for $3.00 and less, and every single one we were charged a $35.00 overdraft fee, and were not even aware of this. Well not until nearly 9 days later when pulled up at ATM, went to make $100 withdrawal and the receipt showed a -$746. balance. I was like what? so I presented it again, thinking it was an error, same thing, and to really take an extra bite, each time I presented the card into the machine was a $35.00 fee, twice for the decline and the balance check. I went into our bank, and was told well we are just the small branch in this little town we cant make decisions to reverse any charges, I asked for the Corporate bank and was told that our branch manager would talk with them but she didn't think we would get any help because it was all computer generated. Well 3 days later and I went back in, and she told me, no the Corporate Bank said no help, all charges stand. Because we had the $1,000 protection they continued to pay, but charged us the draft each and every time., over $1300 in overdraft fees. The customer should always know how much they have in their accounts. If you know you have $50 don't spend $75 and write a check for $100. That is common sense. The next thing is that a major bank I work for is making drastic changes to the overdraft process that will please many people. I normally keep pretty close track of what's spent and how much we have left, but sometimes mistakes happen. I understand that. I accept responsibility for that. What I do not understand is how they can justify re-ordering transactions to go from largest to smallest rather than chronological order. I've had reps tell me that it's "for my convenience," which is utter hogwash, in my opinion. Typically, I have one transaction that should've gone into the red. Not with Bank of America - they re-order it so that I wind up with multiple fees, instead of just one. I'm going to follow Clark's advice from the other night and go to my branch manager and ask him to stop this madness and refund the fees. Even if they do, I still plan on jumping to a credit union at my earliest opportunity. I have a credit card with around $43,000 worth of debt at an interest rate of 11%. I used this credit card to purchase 50% of a business as I wasn't eligible for a small business loan since I'm acquiring a successful business instead of starting one from the ground up and have zero equity so this was my only option. Now that I've committed myself to this debt, I'm not struggling to make payments but would prefer to lower my interest rate to save thousands upon thousands of dollars. My current lender has a program for a 2.99% APR on the lifetime of all balance transfers which I'm trying to take advantage of. The only way for me to take advantage of this program is for me to apply and be approved for a new credit card, transfer my debt to that card, and then transfer it back to my current lender. Sounds complicated; is complicated; and I get denied every time which can't be helping my credit score which was around 720 last I checked. I also have a line of credit through the same lender for 25,000 which is pretty much maxed out. My question is where can I find a credit card that would be willing to accept my large balance transfer and approve me for the card. If that's not possible, any other options? more

I had a client rent a motorcycle from us in San Francisco. The client came to our office and took the bike from our office. Before we let clients take our motorcycles we get a signed 2,500.00 “Authorization” on their credit card. The authorization is used in case the client damages the motorcycle and automatically drops off after the client returns the motorcycle undamaged. This client used his American Express Card to pay for the two separate charges. He signed one credit card slip for the rental and another credit card slip for the deposit. He then took the bike north along Highway 1. Two days later he dropped the motorcycle, while the engine was running, into a large puddle of water in excess of 12 inches deep. The water was sucked into the engine which seized the engine causing over $1,500.00 in damages. The good new for us is that the client called me and asked me to call the local BMW dealer to get advice. I called the BMW dealer and he suggested that the client does not try to start the motorcycle. He should have it towed to their shop. When I relayed this to the client the client then wanted to speak with the BMW dealership directly. I gave him the phone number and the client called the BMW dealer directly. He told the BMW dealer the same story he told me and I now we have an unbiased witness that he dropped the bike into a puddle of water while the engine was running. Thus, implicating himself as being responsible for the damages. The client took our full coverage insurance which has a $2,500 deductable in the event of a “Comprehensive” claim. The client was given a verbal example of a comprehensive claim. He was told that “an example of a comprehensive claim is if you drop the motorcycle accidentally as opposed to a collision”. Collision claims have a $0 (zero) deductable but a police report is required. The bottom line is the client is claiming that the bike engine seized by itself and had nothing to do with being dropped in water. He has refused to accept responsibility for his negligence and has disputed both the rental charges and the damage charges on his credit card bill. American Express has a policy that we just discovered. we can not use their card for damage deposits and they told us to take the client to small claims court. From now on we will not use American Express for damage deposits and will try to avoid using them for anything! I know how to sue him in San Francisco small claims court but how to I go about getting him served to appear in San Francisco? Also, if I win how do I collect? Any help is appreciated! more

He then, signed, dated and sent the form to S Ltd together with a covering letter that stated “Please note that all orders are submitted subject to B Ltd’s terms and conditions, a copy of which is enclosed.” S Ltd sent a letter to B Ltd thanking them for their order and specifying that the ‘Hercules’ would be manufactured and delivered to B Ltd on 31 August 2008 at the listed price of £28,000. The ‘Hercules’ hydraulic jack was delivered to B Ltd on 30 August 2008, together with an invoice for £30,000 which was stated to be payable in full in 30 days. On receiving the invoice Tom telephoned and queried the price, stating that he had agreed a price of £28,000. He was told that S Ltd’s costs had increased and the company use a clause in the company’s terms stating that: “S Ltd reserves the right to increase the price of goods supplied by a maximum of 10%.” Max pointed out that the clause was included in the terms and conditions on the website. I co-own a used book store in a small town. It's the biggest bookstore in the entire valley we live in - the next big store is 45 mins away. Problem is, we are in the "out of the way" town.
